Rental of ventilation therapy equipment

The bidder must confirm that none of the applicable exclusion grounds exists, including recent convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also confirm compliance with tax and social security payment obligations and that it is not bankrupt, insolvent, in liquidation, subject to comparable proceedings, engaged in suspended business activity, guilty of serious professional misconduct, involved in anti-competitive agreements or an unmanageable conflict of interest, or responsible for serious breaches of previous public contracts. The bidder must not have submitted false or misleading information, withheld required information or documents, improperly influenced the procedure or obtained confidential information. National grounds also cover unlawful employment of foreign nationals, international sanctions, and certain tax-related offences. The bidder must provide the required confirmations and, where relevant, explanations and evidence of remedial measures restoring its reliability.

The bidder must have experience in renting home ventilation therapy equipment. During the 36 months preceding publication of the contract notice, it must have properly performed or be performing at least one contract under which a total of at least 50 ventilation therapy devices have been rented. The bid must include the contract date, details of the other contracting party and the number of devices rented, together with confirmation from the other contracting party that the contract was properly performed. The bidder must also have an employee or contract-based representative trained by the manufacturer or its authorised representative to maintain the offered equipment or equivalent products from the same manufacturer, and must submit documentary proof of that training. The bidder must hold the right to represent and sell the offered devices and accessories in Estonia and provide the relevant manufacturer or authorised representative documentation. The devices and accessories must have CE marking and comply with Regulation (EU) 2017/745, or be lawfully marketed under its transitional provisions; the required declarations of conformity, certificates where applicable and manufacturer confirmation concerning transitional compliance must be submitted. The offered medical devices must be registered in the medical devices database administered by the Estonian State Agency of Medicines. The bidder must submit the participation application, complete the data protection and information security requirements, provide a technically compliant bid with all materials required by the technical specification, and submit the price using the prescribed forms. Joint bidders must provide a power of attorney for their authorised representative. The bidder must confirm that Russian-linked subcontractors or suppliers do not account for more than 10% of the contract value and that the offered goods are not subject to international sanctions.
