Compliance requirements
A tenderer must be excluded if it, or a person authorised to represent, manage, control or make decisions for it, has been convicted of participation in a criminal organisation, breach of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the illegal employment of foreign nationals or breaches of their employment conditions, including paying less than the statutory wage; or illegal child labour or human trafficking. Exclusion also applies where the tenderer has outstanding national taxes, charges or environmental levies, or tax or social security contribution debts under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction.
The contracting authority may also exclude a tenderer that has materially or repeatedly breached a previous public contract, resulting in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. It may exclude a tenderer that has provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents.
Qualification criteria and exclusion grounds
The tenderer must have properly performed, during the 36 months preceding the start of the procurement, at least two contracts for mowing services and one contract for snow clearance. The tenderer must submit a list of these contracts using Form 2, “Information on Previous Contracts.”
The price offer must be submitted using Form 3 in Microsoft Excel format. The form’s line items and quantities must not be changed; offers with an altered price table will be rejected. The stated quantities are indicative and are not binding on the contracting authority for contract performance.
During performance of the framework agreement, the tenderer must use Elektrilevi’s Electronic Partner Portal (EPP) and join it before performance begins, following the portal registration form and the partner user guide. In a joint bid, the members must appoint an authorised representative and include their power of attorney with the bid. The tenderer must also confirm that it is not established or resident in Russia or Belarus.
