The bidder must confirm that neither the company nor its management, supervisory body members, representatives or persons controlling the company have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the unlawful use of child labour or other forms of human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations. In addition, the bidder must not have enabled an unlawfully staying foreign national to work or breached the applicable conditions for employing foreign nationals, and must not be subject to an international or national sanction that would make the award of the contract unlawful. Where relevant and permitted, the bidder may provide information on remedial measures taken to restore its reliability. The notice requires the bidder to provide the relevant explanations and evidence if an exclusion ground applies.

The notice does not specify separate financial, technical, professional experience, staffing or certification requirements for bidder qualification. The bidder must submit the tender price using the structure provided in the sheet titled “Award criteria and measurable indicators”. By submitting a tender, the bidder confirms acceptance of all conditions set out in the procurement documents.
