Compliance requirements
The bidder must confirm that neither the company nor its representatives are subject to mandatory or discretionary exclusion grounds. These include final convictions within the relevant period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or trafficking, as well as enabling the employment of unlawfully staying foreign nationals. The bidder must also confirm that it has no tax or social security payment arrears; the stated threshold is EUR 0. The notice also covers breaches of environmental, social and labour law, bankruptcy or insolvency proceedings, liquidation, agreements with creditors, similar financial situations, administration of assets by a liquidator or court, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of earlier public contracts, false or omitted information, failure to provide requested documents, and attempts to obtain confidential information or improperly influence the contracting authority. The national exclusion grounds also include being subject to an international sanction, local tax arrears owed in the contracting authority’s municipality and convictions for tax offences. Where applicable, the bidder must describe the circumstances and any measures taken to demonstrate reliability.
Qualification criteria and exclusion grounds
The bidder must demonstrate that it has completed at least one contract during the 36 months preceding the start of the procurement for transport services for persons with special needs using adapted vehicles. The completed volume of that contract must be at least EUR 180,000 excluding VAT; a contract may still be in progress, but the EUR 180,000 volume must have been completed by the tender submission deadline. The bidder must provide the contract details, including the value, dates, contracting party and contact information.
For service delivery, the bidder must have at least 14 technically sound vehicles available for the contract period: 10 category M passenger cars suitable for taxi and passenger transport, and 4 special-purpose category M1 or M2 minibuses that allow wheelchair users to enter using a ramp or lift. The special-purpose vehicles must have wheelchair restraint systems and seat belts. Two special-purpose vehicles must be continuously available for wheelchair transport in Tartu from 07:00 to 21:00; journeys after 21:00 must be ordered by 18:00. One special-purpose vehicle must be capable of transporting at least two wheelchair users at the same time. Vehicle registration numbers and vehicle card numbers must be provided.
The bidder must hold valid taxi and passenger transport licences, and must have employment or other contracts with the drivers used for the service, together with the required service cards. Staff used to perform the contract must meet the specified criminal-record requirements: they must not have disqualifying convictions or compulsory psychiatric treatment for the offences listed in the tender documents, and any conviction for an intentional offence must not endanger the life, health or property of the persons entitled to the service. The bidder must submit the required service compliance confirmation in Form 4, the price form in Form 5 with every field completed, and, where applicable, the joint bidders’ authorisation in Form 6. The tender must be unconditional and confirm acceptance of all procurement-document requirements.
