Compliance requirements
A bidder must not be subject to grounds for exclusion, including convictions of the bidder or its representatives within the past five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, child labour or human trafficking. Other grounds may include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, an arrangement with creditors or suspended business activity; serious professional misconduct; agreements that distort competition; an unavoidable conflict of interest; involvement in preparing the procurement in a way that creates an unfair advantage; significant or repeated breach of a previous contract; false statements, failure to provide required information or documents, or improper attempts to obtain confidential information. Grounds also include breaches of environmental, social or labour-law obligations, enabling the employment of a foreign national without a lawful basis, and convictions for tax offences. Exclusion also applies if concluding the contract would breach an international or Estonian sanction. The stated threshold for tax and social security arrears is EUR 0; the notice explains that Estonia does not issue a tax-debt certificate for arrears below EUR 100 or where payment has been rescheduled. Where applicable, the procurement passport allows a bidder to submit evidence of measures taken to restore its reliability if an exclusion ground applies.
