Compliance requirements

The bidder must confirm that neither it nor its management, supervisory body members or authorized representatives has been finally convicted within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations. The stated threshold is EUR 0; under Estonian rules, tax debt below EUR 100 or debt covered by a payment schedule may be treated specially. The grounds also cover bankruptcy, insolvency or liquidation proceedings, comparable insolvency situations, assets administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated failures under previous public contracts, false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the contracting authority. National exclusion grounds additionally concern unlawful employment of foreign nationals, international sanctions, convictions for tax offences and restrictions based on the bidder's country of establishment. The bidder must provide the names and personal identification codes of authorized persons not visible in the relevant commercial register extract, or confirm that no such persons exist. First-tier subcontractors will be checked during contract performance; second- and subsequent-tier subcontractors will not be checked under the stated procedure.

Qualification criteria and exclusion grounds

The bidder's net turnover in the last financial year completed before the start of the procurement must be at least EUR 550,000. The bidder must provide the turnover information in the ESPD and, upon request, an extract from the latest annual report or other evidence, unless the information is publicly available to the contracting authority from the relevant register. Joint bidders may aggregate their figures. If the bidder relies on another entity's financial capacity, that entity must be identified, provide the required ESPD, consent to the reliance and accept joint and several liability for the relevant part of the contract. Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least one public road construction contract involving installation of at least 35,000 m² of asphalt concrete wearing course. The bidder must list the contract and, upon request, provide the client's confirmation of the road construction works, the contract completion period, the installed surface area and proper performance. If another entity's technical capacity is used, that entity must provide the required ESPD, consent to the reliance and undertake to participate directly in the relevant part of contract performance. The bidder must submit a complete price schedule, fill in all price fields, and not alter or remove the contracting authority's predefined items, descriptions, parameters, units, quantities or other data. Price totals must be stated in euros to two decimal places, and the completed price schedule must be submitted as an Excel file. The bidder must accept the procurement conditions, submit an offer for all matters for which competing offers are requested, and not use a subcontractor who is subject to replacement under the applicable procurement rules. For a joint bid, separate ESPDs and a signed power of attorney for the authorized representative are required. The bidder must identify any trade secrets and justify that classification, and must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
