The bidder must confirm that neither the company nor its management, supervisory body members, authorised representatives or other controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations, is not bankrupt, insolvent, being liquidated or subject to comparable proceedings, and has not entered into an arrangement with creditors where this constitutes an exclusion ground. Further exclusion grounds concern suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest that cannot otherwise be remedied, involvement in preparing the procurement that creates an unavoidable competitive advantage, serious or persistent breaches of previous public contracts, and false or missing information or failure to provide required documents. The bidder must also confirm compliance with Estonian national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where permitted, the bidder may describe remedial measures demonstrating restored reliability. The bidder must not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia, are more than 50% directly or indirectly owned by such persons or entities, or act on their instructions. The offered goods must not be subject to international sanctions or originate from sanctioned territories.

The bidder must submit a technically compliant offer for the relevant lot or lots, using the required product information and technical description form. The offered medicinal product must have a valid marketing authorisation in Estonia; this must be confirmed in the participation declaration, and the contracting authority will verify it in the State Agency of Medicines register. If the product does not have a valid Estonian marketing authorisation or a relevant professional association application, the contracting authority may apply to the State Agency of Medicines for an import authorisation. The bidder must submit the participation declaration and the completed technical description document, and provide an explanation and supporting evidence for any equivalent product, standard, label or technical solution offered. The price must be submitted in euros, in the prescribed price-form structure, exclusive of VAT, and must include all costs of delivery and unloading at the Tartu University Hospital pharmacy at L. Puusepa 8, Tartu. The quoted unit prices are final and no additional payments or costs will be added. If several companies submit a joint tender, they must appoint an authorised representative and submit the required power of attorney and confirmation of joint and several liability. The bidder must identify and justify any business secret, but may not classify the tender price, lot prices or other price-related evaluation figures as business secrets.
