Reconstruction of the Lubja II feeder at Savi PAJ, Pärnu city, Pärnu County – Phase II (IP8292)

The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant criminal convictions of the bidder or its representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorism financing, illegal employment of foreign nationals, breaches of foreign workers’ employment conditions, unlawful use of child labour or human trafficking. The bidder must also have no outstanding state tax, payment or environmental charge debt, and entering into the contract must not breach an international or Estonian Government sanction. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information or failed to provide required qualification information or additional documents. The bidder must confirm that these exclusion grounds do not apply. Participation is not permitted for undertakings established or resident in the Russian Federation or the Republic of Belarus. Materials, equipment, goods and components originating from or produced in Russia or Belarus may not be installed or used in the works; the contracting authority may request certificates of origin.

The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts showing the turnover, unless the information is publicly available to the contracting authority from a register for an Estonian company. If the financial year does not coincide with the calendar year, the requirement applies to the three most recently completed financial years, and at least six months must have elapsed since the end of the latest completed financial year by the tender submission date. During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one of those contracts must have had a value of at least EUR 80,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the other contracting party’s details and the client representative’s telephone number and email address, as well as the procurement reference numbers where applicable. Evidence of proper performance must be submitted upon request unless the information can be obtained from public or private databases without significant expense. The bidder must have an electrical works manager with a valid A-competence certificate and/or a qualification corresponding to at least level 6 under the Estonian Professional Qualifications Act. The person must hold the required evidence by the tender submission date and must be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must have a person with switching rights for work-related switching operations in the 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energisation and restoration of the normal network configuration, except in regional and distribution substations. This person must be registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side above 1 kV up to 20 kV. The bidder must also have a person responsible for the work operation, registered in Elektrilevi’s partner portal before tenders are opened. The tender must include information about the person authorised to sign the contract and a contact person for contract-performance matters. If signing authority does not arise from the articles of association, a power of attorney must be submitted. The tender must comply with all procurement documents and may not contain additional or conditional terms. The price must be submitted using the required price table, with all unit-price fields completed. The bidder must state any business secrets and explain the classification; the tender price and other legally protected evaluation-related figures may not be classified as business secrets.
