Renewal of the Mäetaguse-Nipso drainage system and roads

The tenderer must confirm that neither the tenderer nor its management, supervisory body members, authorised representatives or other persons controlling the tenderer have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, the use of child labour or other forms of human trafficking. The tenderer must also confirm that it has not breached tax or social security payment obligations. The stated threshold for tax and social security debts is EUR 0; under the applicable tax rules, a tax debt certificate is not issued where the total debt is below EUR 100 or payment has been deferred. The exclusion grounds also cover breaches of environmental, social or labour law obligations; bankruptcy, insolvency, liquidation or comparable situations; agreements with creditors; assets being administered by a liquidator or court; suspended business activity; serious professional misconduct; agreements restricting competition; conflicts of interest; involvement in the preparation of the procurement giving an improper advantage; serious or persistent breaches of previous public contracts resulting in early termination, damages or penalties; and the submission of false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the contracting authority. The tenderer must additionally confirm that no relevant person has been convicted for enabling an unlawfully staying foreign national to work or for paying below the statutory wage level, that entering into the contract would not breach international or Estonian sanctions, and that no person subject to the relevant national exclusion grounds is used. Where an exclusion ground exists, the tenderer may, where legally permitted or provided for in the procurement documents, submit evidence of remedial measures restoring its reliability.

The tenderer must provide at least one responsible person for the road works holding a level 6 road engineer qualification or an equivalent or higher qualification specialising in road construction. The tenderer must submit the person's details and evidence of the qualification. If the qualification was not issued in Estonia, the tenderer must provide a copy of a licence or other evidence from the person's home country proving the right to perform the relevant work. The contracting authority may request additional evidence of the person's relationship with the tenderer in the context of this procurement. For the drainage works, the tenderer must have an appropriate legal relationship, under Section 36 of the Estonian Land Improvement Act or an equivalent provision of the tenderer's home-country law, with a responsible specialist; an individual entrepreneur may act as the responsible specialist itself. The tenderer must provide the responsible person's details and evidence of an equivalent or higher qualification. The same rules apply to foreign qualifications and evidence of the right to perform the relevant work. Within the 60 months preceding the start of the procurement, the tenderer must have completed at least one qualifying construction works contract either as the main contractor or as a subcontractor carrying out or organising all construction works. The requirement may be met by either of the following alternatives: - Alternative 1: construction or complete reconstruction of a drainage system, including at least 35 km of ditches, at least 50 culverts with a diameter of at least 400 mm, and construction or complete reconstruction of at least 7 km or 35,000 m² of eligible roads; or - Alternative 2: complete renewal or maintenance of a drainage system, including restoration of at least 175 km of ditches, maintenance of at least 250 culverts with a diameter of at least 400 mm, and construction or complete reconstruction of at least 7 km or 35,000 m² of eligible roads. The tenderer must list the relevant completed contracts in the ESPD. At the contracting authority's request, it must provide a client confirmation that the work was properly completed or, where the tenderer acted as a qualifying subcontractor, confirmation from the main contractor. If the tenderer relies on another undertaking's capacity, that undertaking's ESPD must also be submitted. Planned subcontractors, their contact details, legal representatives, the scope and nature of subcontracting must be disclosed. The tender must include the required price offer form and, where applicable, the power of attorney for joint tenderers. A bid guarantee of EUR 2,000 must be provided by a credit or financial institution or insurer, or by depositing the amount in the contracting authority's account; it must remain valid at least until the end of the tender validity period. The tender must be unconditional and comply with all procurement documents. Any proposed equivalence to a specified standard, technical requirement, product, process or certificate must be explained and supported by evidence. The tenderer must also confirm compliance with RMK environmental requirements for forestry work, the prohibition on using a subcontractor subject to mandatory replacement, the applicable sanctions restrictions on subcontractors and suppliers, and the required arrangements for informing employees about their labour rights and resolving labour disputes and complaints.
