Compliance requirements
The bidder must confirm that neither the company nor its representatives or controlling persons is subject to exclusion grounds relating to criminal convictions, corruption, fraud, terrorism, money laundering, terrorist financing, child labour or human trafficking. The bidder must also confirm compliance with tax and social security payment obligations and that it is not bankrupt, insolvent, being liquidated or subject to comparable proceedings. Other grounds include serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of previous public contracts, false or withheld information, failure to provide requested documents, and breaches of environmental, social or employment law. The bidder must disclose authorised persons who are not visible in the commercial register and provide their names and personal identification codes, or confirm that no such persons exist. The bidder must confirm that the contract will not be performed using subcontractors or suppliers exceeding 10% of the contract value who are Russian citizens, residents or entities established in Russia, entities more than 50% directly or indirectly owned by them, or persons acting on their behalf or instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The precise declarations and any supporting evidence must be submitted as required by the tender documents; where applicable, self-cleaning evidence may be provided.
Qualification criteria and exclusion grounds
The bidder’s net turnover in the last financial year completed before the start of the procurement must be at least EUR 190,000. Joint bidders may aggregate their turnover. The contracting authority may request an annual report extract or other evidence of turnover; if the bidder relies on another entity’s financial capacity, that entity must provide the required consent and bears joint and several liability for the relevant part of the contract.
During the 36 months preceding the start of the procurement, the bidder must have completed at least three contracts for the sale and/or provision for use, including leasing, of firewall and/or VPN equipment. Each contract must have had a value of at least EUR 60,000 excluding VAT. The bidder must provide contract details and, upon request, buyer confirmations stating the performance period and contract value. If another entity’s technical or professional capacity is used, that entity must consent and participate directly in the performance at least to the extent corresponding to the relied-on capacity.
The bidder must have an information security management system compliant with ISO 27001 or an equivalent system. Upon request, the bidder must provide an ISO 27001 certificate or equivalent confirmation from an independent auditor or accredited certification body. Reliance on another entity’s certificate is not permitted.
The contract performance team must include five Fortinet-certified technical engineers: two with a valid Fortinet NSE 4 certificate, two with a valid Fortinet NSE 7 certificate, and one with a valid expert-level Fortinet NSE 8 certificate. Copies of the engineers’ certificates must be submitted.
The bidder must be an official partner of the manufacturer of all solutions offered and have the right to sell them in Estonia. The equipment must be supplied through the manufacturer’s official distribution channel, and all offered solutions must be from the same manufacturer. Valid manufacturer-issued partner certificates must be submitted. The offer must include the fully completed price breakdown in the required Excel format, with all amounts in euros to two decimal places, without altering the template. The bidder must accept the tender conditions, explain and document any proposed equivalence, and identify and justify any business secrets.
