The tenderer must confirm that neither the tenderer nor its management, supervisory or authorised representatives are subject to exclusion grounds relating to final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or other forms of human trafficking. The tenderer must not have outstanding tax or social security payment obligations. The exclusion checks also cover breaches of applicable labour-law obligations, insolvency or liquidation proceedings, serious professional misconduct, agreements intended to distort competition, conflicts of interest that cannot be avoided, participation in preparing this procurement that creates an unavoidable competitive advantage, and serious or repeated breaches of previous public contracts resulting in early termination, damages or comparable sanctions. The tenderer must not have submitted false or misleading information, withheld required information, failed to provide requested documents, or sought confidential information or improperly influenced the contracting authority. Additional national grounds include convictions or breaches concerning the employment of unlawfully staying foreign nationals, international sanctions, local taxes owed in the contracting authority’s location and tax offences. The tenderer must confirm that it and its representatives have not engaged in corrupt conduct in this procurement and that its registered or permanent place of residence is not in the Russian Federation or the Republic of Belarus. The tenderer must disclose persons authorised to represent, control or make decisions for the business, including subcontractors, where those persons are not visible to the contracting authority in the relevant public registers, or confirm that no such persons exist. Where an exclusion ground may apply, the tenderer may provide information on measures taken to restore its reliability if this is permitted for the procurement.

The tenderer must have completed at least two contracts for the detailed design of public squares during the 36 months preceding the start of the procurement. Each contract must concern a designed area of at least 1,500 m². The ESPD must include the contract description, signing and completion dates, contract value and details of the other contracting party, including the client’s name and contact person, email address and telephone number. If requested, the tenderer must provide additional explanations, information or documents within five working days where the information is not readily available to the contracting authority from public registers. The contracting authority may also contact the other contracting party. The tenderer must confirm that it has reviewed the technical description and that, in addition to the persons submitted for the qualification requirement, it will involve the specialists required for the separate technical sections. After contract award, the successful tenderer must provide a list of the persons involved and their professional qualification certificates or other supporting documents when required. This applies also to specialists working through subcontractors. The bid must comply with all procurement-document requirements and use the prescribed structure. The price must be submitted in euros excluding VAT, with two decimal places, both on the required price form and in the procurement register. Every required line in Annex 2 must be completed without substantive changes or added conditions. Blank fields, zero or negative unit prices may result in rejection. The price must include all costs necessary for proper performance of the contract. A properly completed Annex 2 price and payment schedule must be submitted. For a joint bid, a digitally signed power of attorney appointing the joint tenderers’ representative must be included. The tenderer must also identify any business secrets and justify their classification, or confirm that the bid contains no business secrets.
