Construction of a Microfilter

The bidder must confirm that neither it nor its management, supervisory or authorised representatives have final convictions within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also confirm that it has no unpaid taxes or social security contributions. The notice specifies a EUR 0 threshold; however, tax authorities do not issue a tax-debt certificate where the total debt managed by the same authority is below EUR 100, excluding undetermined interest, or where payment has been deferred. Foreign bidders must provide evidence in accordance with the law of their country of establishment. The bidder must not be in bankruptcy, liquidation, insolvency proceedings or a comparable situation, have suspended business activities, have seriously breached professional conduct rules, entered into agreements intended to distort competition, have an unavoidable conflict of interest, participated improperly in preparing this procurement, or have had previous public contracts terminated early or sanctioned because of significant or repeated breaches. The bidder must not submit false or incomplete information, fail to provide requested documents, or attempt to obtain confidential information or improperly influence the contracting authority. National exclusion grounds also cover enabling the employment of an unlawfully staying foreign national, being subject to international sanctions, convictions for tax offences and participation restrictions based on the bidder’s place of establishment. The bidder must provide the required confirmations in the ESPD and, where applicable, describe any remedial measures and provide supporting evidence. First-tier subcontractors will be checked during contract performance, and the bidder must not engage a subcontractor who would have to be replaced under the applicable procurement law.

The bidder must demonstrate technical and professional capacity by providing at least one contract completed during the 60 months preceding the start of the procurement. The contract must be similar to the subject of this procurement and must include the construction of at least one microfilter, ultrafilter or nanofilter for a wastewater treatment plant. The ESPD must include the contract description, completion period, contracting parties, total value and the bidder’s scope and percentage share of the completed works. The contracting authority may request confirmation from the client that the contract was properly completed. References may be based on the bidder’s own experience, a joint bidder’s experience or a subcontractor’s experience. If the bidder relies on another undertaking’s or joint bidder’s resources, it must provide that entity’s details and demonstrate access to the relevant resources. The bid must comply with all tender documents and may not be conditional. The bidder must submit the completed Form_1_1_Work volume list and provide the bid price in the required structure. Any proposed equivalent solution must be explained and supported by evidence. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. The bidder must confirm that its registered office or place of establishment is in Estonia, another EU Member State, an EEA contracting state or a WTO Government Procurement Agreement member country. It must also provide the names and personal identification numbers of authorised persons who are not visible to the contracting authority in the Commercial Register, or confirm that no such persons exist. The bidder must identify any trade secrets and justify that designation; the bid price and other prohibited numerical bid indicators may not be classified as trade secrets.
