Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder and members of its administrative, management or supervisory bodies must not be subject to exclusion grounds, including a final conviction for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, child labour or human trafficking. Checks generally cover the previous five years or any exclusion period still in force under a court judgment. Failure to meet tax or social security payment obligations may also lead to exclusion. The stated tax-debt threshold is EUR 0; however, an Estonian tax-debt certificate is not issued where the debt is below EUR 100 or payment has been deferred. Other possible grounds include bankruptcy, insolvency or liquidation proceedings, assets being administered by a liquidator or court, suspended business activities, an arrangement with creditors or a similar situation. Grounds may also include serious professional misconduct, an agreement distorting competition, an unavoidable conflict of interest, an unfair advantage gained through involvement in preparing the procurement, or a material or repeated breach of a previous contract resulting in termination, damages, a price reduction or a contractual penalty. Exclusion may follow from submitting false information, failing to provide required information or documents, improperly influencing the decision-making process, or seeking confidential information to gain an unfair advantage. Breaches of environmental, social and labour-law obligations are also relevant. A mandatory ground applies where a person residing in the country without a lawful basis is enabled to work, or where rules on the conditions of a foreign national’s employment in Estonia, including applicable wage requirements, are breached. Other possible grounds include being subject to international sanctions and conviction for a tax offence. Where applicable, the bidder may provide evidence of remedial measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must have the right to sell the products offered. This must be evidenced by a document issued by the manufacturer or an authorised supplier; if issued by a supplier, include the manufacturer’s document confirming that supplier’s authority. Submit a technical offer complying with Annex 1, together with manufacturer-issued technical specifications, instructions for use and supporting materials. The offered products must bear the CE marking and comply with Regulation (EU) 2017/745 or its transitional provisions; provide copies of the declarations of conformity and, where applicable, EC certificates, clearly identifying the products offered. The manufacturer’s technical documentation must be in English, and any manufacturer-specific terms must be explained. Where equivalence is claimed, explain it and provide supporting evidence. Submit the participation application using Annex 4, Form II. Joint bidders must appoint an authorised representative and provide the relevant power of attorney. Identify any trade secrets in the bid and explain why they qualify; prices and other specified evaluation-related figures may not be treated as trade secrets. Submit the price offer in euros, separately by lot, using the required pricing structure and Annex 2 in Excel format. State each product’s name, manufacturer, product code/reference number, unit price and total price for the lot. All products offered within a lot must be from the same manufacturer. Prices must include all delivery and unloading costs to the Tartu University Hospital Neurology Clinic at L. Puusepa 8, Tartu, Building H, 4th floor, room 401, and must be final, with no additional charges. The bid must also include the system-generated price document in the required structure. The machine-readable information does not specify the award-scoring method. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; entities more than 50% owned by such persons or entities; or persons or entities acting on their behalf or under their direction. The offered goods must not be subject to international sanctions or originate from sanctioned regions.
