Compliance requirements
A bidder may be excluded for final convictions within the previous five years, or an exclusion period still in force, involving participation in a criminal organization, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover failure to pay taxes or social security contributions, bankruptcy or insolvency, liquidation, creditor arrangements, suspended business activities, serious professional misconduct, competition-distorting agreements, an unmanageable conflict of interest, involvement in preparing the procurement that creates an unavoidable competitive advantage, and serious or persistent breaches of previous contracts resulting in early termination, damages or comparable sanctions.
Exclusion may also apply for false or misleading information, failure to provide required information or documents, improper attempts to influence the procurement or obtain confidential information, breaches of environmental, social or labour obligations, enabling the illegal employment of a foreign national, being subject to international sanctions, or tax-related criminal convictions. For the tax-debt grounds, the notice states a threshold of EUR 0; however, under the stated national rules, a tax-debt certificate is not issued where the relevant tax debt is below EUR 100 or payment has been deferred. Where applicable, the bidder may submit evidence of measures taken to restore its reliability; this possibility applies where the procurement exceeds the international threshold or the tender documents provide for it.
Qualification criteria and exclusion grounds
For each of the seven lots, the bidder must have performed at least one contract for products offered in this procurement during the three years preceding publication of the contract notice; the contract may still be in progress. The bid must include a list of the main relevant sales contracts, with their dates and information about the other contracting parties.
The bidder must submit the participation declaration, a technically compliant offer, and a price schedule in the required formats. Prices must be in euros and stated separately for each lot; all products within a lot must be from the same manufacturer. Prices must include delivery and unloading at the hospital’s neurology clinic and be final, with no additional charges.
The bidder must hold the right to sell the offered products and provide evidence issued by the manufacturer or an authorized supplier; if issued by a supplier, evidence that the manufacturer authorized that supplier must also be provided. The bid must include the manufacturer’s detailed product specifications, instructions for use and supporting materials demonstrating compliance with the technical requirements. Any company-specific terminology must be explained. Products must bear CE marking and be marketed in accordance with the transitional provisions of Regulation (EU) 2017/745; applicable conformity certificates and declarations must be provided, with the offered products clearly marked if listed among other products.
Product samples must be submitted with the bid in the quantities specified in the price schedule, in unopened original packaging and labelled with the product code, name and lot number. Samples are not required for products already used by the hospital under a contract during the preceding procurement period. The hospital may request additional samples for practical testing, which must be delivered within 3 working days of the request; failure to do so may result in rejection of the bid. Joint bidders must appoint an authorized representative and submit the required power of attorney and confirmation of joint and several liability. The bidder must identify and justify any information claimed as a trade secret; prices and evaluation-related figures may not be classified as trade secrets. The bid must confirm compliance with the tender documents and explain and substantiate any claimed equivalence. The provided documents do not specify the award scoring criteria; consult the official tender details.
