Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant criminal convictions involving the bidder or persons authorised to represent, manage or control it, including participation in a criminal organisation, breaches of integrity duties, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful employment of foreign nationals, breaches involving the employment of children or trafficking in human beings. The bidder must also have no outstanding state taxes, duties or environmental charges, or tax or social security payment arrears under the law of its country of establishment.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information or failed to provide required qualification information or additional documents. The bidder must confirm that none of these voluntary exclusion grounds apply.
Companies established in the Russian Federation or the Republic of Belarus may not participate. The bidder must also confirm that materials, equipment, goods and components used in the works are not produced in or originating from Russia or Belarus; certificates of origin may be requested as evidence.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the launch of the procurement. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list stating the performance period, information about the other contracting party, including the client's representative's telephone number and email address, and the reference numbers for public contracts. Evidence of proper performance must be submitted if requested, unless the contracting authority can obtain the information from public or private databases without significant expense.
The team must include a switching-authorised person for work-related switching in 0.22–20 kV electricity networks, including operational switching, isolation and earthing, re-energisation and restoration of the normal network configuration, except in regional and distribution substations. For low-voltage-only works at 0.22–1 kV, at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where medium-voltage switching is needed to perform low-voltage works. The person must be registered in Elektrilevi's Partner Portal before the bids are opened, and the relevant training and authorisation rules must be followed.
The bidder must have a person responsible for the work operation, registered in Elektrilevi's Partner Portal before the bid submission deadline. The team must also include a person leading the electrical works who has valid A competence and/or a qualification corresponding to at least level 6 under the Estonian Qualifications Act, holds the relevant evidence when the bid is submitted, and is registered in the Partner Portal before the deadline.
The bid must comply with all tender document requirements; conditional or supplementary bids are not allowed. The price must be submitted using the required table, with every unit-price field completed. The bidder must provide the names, positions and contact details of the contract signatory or signatories and the contract-performance contact person; a power of attorney is required if signing authority does not arise from the articles of association. The bidder must identify and justify any trade secrets, while the bid price and other prohibited bid indicators may not be designated as trade secrets. A completed form for previous contracts and the required price table must be included in the bid.
