Compliance requirements
The bidder must confirm that neither it nor its management, supervisory body members or authorised representatives is subject to exclusion grounds. These include recent final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and offences involving child labour or human trafficking. The bidder must also have fulfilled its tax and social security payment obligations. Other grounds include breaches of environmental, social or labour law; bankruptcy, liquidation, insolvency or comparable situations; arrangements with creditors; assets administered by a liquidator or court; suspended business activities; serious professional misconduct; agreements intended to distort competition; conflicts of interest; involvement in preparing this procurement that creates an unfair advantage; serious or repeated failures under previous public contracts or concessions; submission of false or incomplete information or failure to provide required documents. National exclusion grounds also concern enabling the employment of unlawfully resident foreign nationals, being subject to an international sanction, certain local tax debts and convictions for tax offences. Where applicable, the bidder must disclose the circumstances and any measures taken to restore its reliability. The bidder must also be able to provide evidence or information allowing the contracting authority to verify tax and social security compliance.
Qualification criteria and exclusion grounds
The bidder must have at least EUR 10,000 in available funds, or the possibility of using funds in that amount when necessary, to properly perform the concession agreement, including the year-round and uninterrupted operation of the shop on Prangli Island and the supply of goods. The contracting authority may verify compliance after the bid submission deadline and before concluding the concession agreement. At the authority’s request, the bidder must provide a bank statement or another suitable document, such as confirmation from a credit or financial institution, a bank account statement, a written confirmation from a supplier or wholesaler granting payment terms or credit of at least EUR 10,000, or equivalent evidence. If the bidder relies on another entity’s resources, it must prove that those resources will actually be available throughout contract performance. The bid must comply with all procurement documents, may not be conditional, and must follow the required price submission structure. Joint bidders must appoint an authorised representative and include the relevant power of attorney with the bid.
