Compliance requirements
The bidder must confirm that neither the company nor its representatives is subject to exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must not have outstanding tax or social security payment obligations. Other grounds include breaches of environmental, social or labour-law obligations, bankruptcy, insolvency or liquidation proceedings, agreements with creditors, comparable situations under national law, administration of assets by a liquidator or court, suspended business activities, serious professional misconduct, competition-distorting agreements, conflicts of interest, involvement in preparing this procurement, serious or repeated breaches of previous public contracts resulting in early termination or sanctions, and the submission of false or incomplete information or failure to provide required documents. The bidder must also confirm that no national exclusion ground applies in relation to unlawful employment of foreign nationals, international sanctions, tax offences or any applicable local tax debt. Where permitted, evidence of remedial measures restoring reliability may be submitted.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract for the design of a publicly used road or street during the 36 months preceding the publication of the contract notice. The contract value must have been at least EUR 30,000 excluding VAT, and the design work must have been delivered to the client during that period. The bid must include the contract period, value, description, the bidder’s responsibilities and the contracting authority’s representative’s contact details, including telephone number and email address; public procurement reference numbers must also be provided where applicable. The service team must include: (1) a landscape architect qualified at least as an authorised landscape architect, level 7, or a diplomate landscape architect, level 7 under the European Qualifications Framework, or an equivalent qualification; and (2) a road engineer qualified at least as a diplomate road engineer, level 7, with a relevant specialisation in road design, road construction, road project preparation or design management, or an authorised road engineer, level 8, under the European Qualifications Framework, or an equivalent qualification. The bidder must provide each specialist’s name, qualification, evidence document number, issue date and issuing authority. Qualifications obtained outside Estonia must be supported by evidence with an Estonian translation. At the contracting authority’s request, the successful bidder must submit signed CVs in the prescribed form. The bid must comply with all procurement documents and must not be conditional.
