The bidder must confirm that neither the bidder nor its management, supervisory bodies, authorised representatives or persons controlling it have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, terrorism-related offences, corruption, fraud, money laundering or terrorist financing, or the use of child labour and other forms of human trafficking. The bidder must also not have outstanding tax or social security payment obligations. The notice refers to a EUR 0 threshold; under the applicable tax rules, a tax debt below EUR 100 or a tax debt covered by an approved payment schedule may be treated differently when issuing a certificate. The bidder must not be in bankruptcy, liquidation, insolvency proceedings or a comparable situation, have suspended business activities, have seriously breached environmental, social or labour-law obligations, committed serious professional misconduct, entered into agreements distorting competition, have an unavoidable conflict of interest, or have obtained an advantage through involvement in preparing the procurement. Previous substantial or repeated contract breaches resulting in early termination, damages or penalties, as well as false information, withheld information or failure to provide requested documents, may also lead to exclusion. National grounds include enabling the employment of an unlawfully staying foreign national, being subject to international sanctions, and certain tax offences. Where legally permitted, the bidder may provide evidence of measures taken to restore its reliability. The bidder must also confirm that it will not use a subcontractor who would have to be replaced under the applicable public procurement rules.

The bidder’s average net turnover for the three latest financial years must be at least EUR 500,000. The bidder must provide the turnover data in the European Single Procurement Document and, upon request, extracts from the three latest completed annual reports, unless the information is publicly available to the contracting authority through a data register for an Estonian legal entity. During the 60 months preceding the launch of the procurement, the bidder must have properly completed at least two design-and-build contracts for improving the energy efficiency of publicly used buildings under reconstruction, each involving a building with at least 1,000 m² of enclosed net floor area. The bidder must provide a list of these contracts, including the contract and completion dates, the building’s enclosed net floor area and the client’s name and contact details, together with client confirmation letters certifying proper performance. The project team must include: a responsible design and construction project manager with a diploma-level construction engineer qualification at level 7 or higher, or equivalent; a heating, ventilation and cooling engineer at level 7 or higher, or equivalent; a responsible high-voltage systems specialist who is an electrical engineer at level 6 or higher, or equivalent; and a responsible low-voltage systems specialist, or specialists, holding the qualification of security systems designer at level 6 and responsible security systems specialist at level 5, or higher or equivalent qualifications under the European Qualifications Framework or an equivalent framework. If the bidder relies on another entity’s capacity, it must prove that the entity has the required resources, agrees to their use and will participate in performing the relevant contract or part of it. For experience and professional qualifications, the supporting entity must personally perform the relevant work where required by law. The bidder must submit a compliant, unconditional tender, complete and submit the required tender form in Annex 2, and provide the price in the structure specified in the sheet for award criteria and rated indicators. Any claimed trade secret must be identified and justified; the tender price and other legally non-confidential evaluated figures may not be classified as trade secrets. In a joint tender, the joint tenderers must appoint an authorised representative and submit the relevant authorisation. The bidder must confirm compliance with the procurement documents and provide explanations and evidence of equivalence where applicable. First-tier subcontractors are checked during contract performance and must submit the required European Single Procurement Document.
