Compliance requirements

The bidder must not be subject to mandatory exclusion grounds: the company or its management and representative persons must not have been convicted of offences related to organised crime, corruption, fraud, terrorism, money laundering, enabling unlawful employment, illegal child labour or human trafficking. The bidder must also have no outstanding tax, payment or environmental charge debts. The contracting authority may exclude a bidder for a serious or repeated breach of a previous procurement contract, including termination, price reduction, compensation or a contractual penalty, or for submitting false information or failing to provide required documents. The bidder must confirm that these exclusion grounds do not apply. Companies established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components originating from Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

Within the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of contracts showing the performance period, information about the other contracting parties, the contact details of the client’s representative, and, for public contracts, the reference numbers. Upon request, evidence of proper performance must be provided. The team must include a person with the switching rights required for work on a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only, at least MP switching rights are required; in other cases, both MP and KP switching rights are required. The team must also include a person responsible for the work operation, registered in the same portal before the tender submission deadline, and a person managing the electrical works who has valid A competence and/or a qualification corresponding to at least level 6 under the Estonian Qualifications Act, the relevant certificate and portal registration. The tender must comply with all tender document requirements; conditional tenders or tenders containing additional conditions are not permitted. The bidder must submit a properly completed price table with all unit-price fields filled in, the details of the contract signatory and contact person, and a power of attorney where necessary. The bidder must take account of the selected payment term: 14 calendar days for a contract value up to EUR 59,999, 35 calendar days for EUR 60,000–249,999, or 45 calendar days for EUR 250,000 or more; the payment term is 95 calendar days under the factoring programme. Any confidential business information must be identified and justified, but the tender price and other prohibited numerical indicators may not be classified as trade secrets.
