Construction works for the near-zero-energy wing of Keila School’s Pargimaja

The bidder must confirm that neither the company nor its management, representatives or controllers is subject to exclusion grounds such as final convictions within the last five years or an ongoing exclusion period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The bidder must also confirm that it has no unpaid taxes or social security contributions, unless the obligations have been fulfilled or a binding payment arrangement has been concluded. The bidder must not be bankrupt, in liquidation, insolvent, under comparable proceedings, subject to creditor arrangements, have suspended business activities, have committed serious professional misconduct, entered into agreements distorting competition, have an unavoidable conflict of interest, have improperly participated in preparing the procurement, or have seriously or repeatedly breached previous public contracts resulting in termination, damages or penalties. The bidder must not have submitted false or misleading information, withheld required information or documents, or improperly sought confidential information or influenced the contracting authority. The national exclusion grounds also cover enabling the employment of an unlawfully staying foreign national and being a subject of international sanctions. The bidder must confirm compliance with the applicable restrictions concerning Russian-linked persons and entities. First-tier subcontractors are checked during contract performance and must submit a European Single Procurement Document; the bidder must not engage a subcontractor who would have to be replaced under the applicable procurement rules.

The bidder must be registered in the relevant business register in its country of establishment. A foreign bidder must provide registration evidence if requested. Financial and insurance requirements: - During contract performance, the successful bidder must have construction all-risks insurance covering all risks arising from the works, including equipment, machinery and the building. The indemnity limit must be at least the contract price including VAT, with a deductible of no more than EUR 5,000. The structured requirement states a minimum amount of EUR 7,000,000. - During contract performance, the successful bidder must have civil liability insurance covering personal injury and property damage caused to the contracting authority and third parties by the contractor and its subcontractors. The limit must be at least EUR 1,000,000 per insured event and, where an aggregate annual limit applies, at least EUR 2,000,000 per insurance period. The deductible may not exceed EUR 5,000, and subcontractor liability must be covered. Policies must remain valid throughout the contract period. - Together with the ESPD, the bidder must submit a confirmation letter from a credit institution, financial institution or insurer registered in Estonia, or from a corresponding foreign branch, confirming that the required civil liability policy can be issued within 14 days after the tender is declared successful and before the contract is signed. - The bidder must have, or be able to obtain, freely available funds or financing of at least EUR 1,500,000 for contract performance and must provide a bank statement, confirmation letter or equivalent evidence if requested. The stated period is 02 November 2026 to 17 July 2028. Technical and professional capacity: - Within the 60 months preceding publication of the contract notice, the bidder must have completed as main contractor at least one near-zero-energy building project. The project must have involved constructing, extending or reconstructing a building with at least 3,000 m² of net floor area, classified as an office building or a public building, including educational, healthcare or entertainment use, and the works must have had a value of at least EUR 3,000,000 excluding VAT. - The reference project must have included the load-bearing structure and external envelope, interior construction, central mechanical ventilation with heat recovery, central cooling, heating, central building automation, electrical and low-voltage systems. The bidder must provide contract details, the contract period, object, contracting partner and, where applicable, the procurement reference. The successful bidder must provide the client’s confirmation that the contract was properly performed. - The project manager and site manager must be different people. The project manager must hold a level 7 building engineer qualification or equivalent, specialising in building construction and construction activity management. The site manager must hold at least a level 6 building engineer qualification or equivalent with the same specialisation and competence. - The responsible specialists must include: a high-voltage electrical works specialist with at least a level 7 electrical engineer qualification or an A-class competence certificate; responsible fire alarm and security automation specialists with level 5 or equivalent qualifications as a fire safety specialist, security systems technician and automation specialist; a level 7 or equivalent heating, ventilation and cooling engineer for indoor climate systems; a level 7 or equivalent energy-efficiency specialist; a level 7 or equivalent water supply and sewerage engineer; a level 7 authorised landscape architect; and a level 6 road engineer. - The bidder must provide each specialist’s position, name, personal identification details and professional or competence certificate number. At the contracting authority’s request, evidence of education and professional qualifications must be submitted, including for specialists engaged through subcontracting. - The project manager and site manager must each have experience as a project or site manager on at least one near-zero-energy building project during the last 60 months. Their CVs must be digitally signed by the named specialists and submitted with the tender. The form listing responsible specialists must also be completed and submitted. - The bidder must have a construction-sector quality management system meeting at least ISO 9001 or an equivalent standard, supported by an independent auditor or accredited certifier. It must also have a construction-sector environmental management system meeting at least ISO 14001 or an equivalent standard, with the required evidence stated in the ESPD. Tender compliance and evidence: - The tender must follow the specified price structure and include the completed file “RH315399_Hinnapakkumise tabel”; no row may be blank or have a value of EUR 0. The total tender price must be submitted in euros excluding VAT, to the nearest cent, and must include all costs necessary to achieve the procurement objective. Price is the only award criterion, and the lowest compliant price is selected; an earlier submission prevails in the event of a tie. - The bidder must confirm that it accepts all procurement-document conditions, has inspected the site and relevant circumstances, has the necessary rights, resources and competence, and will correct defects and provide the required guarantee. Joint bidders must submit a power of attorney and accept joint and several liability. - Any claimed equivalence to a required standard, product, process, label or certificate must be explained and supported by acceptable evidence. - The bidder must undertake noise-reduction measures, comply with Keila’s external environmental noise action plan, handle construction waste in accordance with Keila’s waste-management rules, and plan the works so that teaching can continue with minimal disruption while part of the school complex remains in use. The tender must also include the required confirmation concerning Russian-linked persons and entities and the completed responsible-specialists form.
