Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant criminal convictions of the bidder or its representatives, violations concerning the employment of foreign nationals, illegal use of child labour or human trafficking, outstanding national taxes, duties or social security contributions, and circumstances that would breach international or Estonian sanctions. The contracting authority may also exclude a bidder for serious or persistent breaches of previous public contracts, or for submitting false information or failing to provide required information or documents. Participation is prohibited for entities established or resident in the Russian Federation or the Republic of Belarus. The bidder must also confirm that materials, equipment, goods and components used in the works are not produced in or originating from Russia or Belarus; certificates of origin may be requested.
Qualification criteria and exclusion grounds
The bidder must have had net sales of at least EUR 300,000 in each of the last three completed financial years. The bidder must submit extracts from the annual accounts showing the net sales, unless the information is publicly available to the contracting authority from a data register. If the financial year does not correspond to the calendar year, the requirement applies to the three most recently completed financial years, and at least six months must have elapsed since the end of the last completed financial year by the tender submission date.
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one of these contracts must have had a value of at least EUR 80,000 excluding VAT. A list of contracts must be submitted, including the performance period, the other contracting party’s details and the client representative’s telephone number and email address; public procurement reference numbers must also be provided where applicable. Evidence of proper performance must be submitted if requested, unless the contracting authority can obtain it from public or private databases without significant expense.
The bidder must have an electricity works manager with a valid A-level competence and/or a qualification corresponding to at least level 6 under the Estonian Occupational Qualifications Act. The person must hold the relevant evidence by the tender submission date and must be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person with valid switching rights for the switching operations required in the 0.22–20 kV electricity network, excluding regional and distribution substations, and this person must be registered in the partner portal before tenders are opened. For works limited to 0.22–1 kV, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side. A person responsible for the work operation must also be appointed and registered in the partner portal before tenders are opened.
The tender must comply with all procurement documents; conditional tenders or tenders containing additional conditions are not permitted. The price must be submitted using the required price table, with every unit-price field completed, and must include the estimated 70 m² of landscaping restoration. The bidder must provide the names, positions and contact details of the contract signatory or signatories and a contact person for contract performance; a power of attorney must be included if signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and submit the relevant authorisation.
