A tenderer will be excluded if any of the exclusion grounds under points 1–5 of Section 95(1) of the Estonian Public Procurement Act applies; the tenderer must confirm the absence of these grounds in the public procurement register. The contracting authority may also exclude a tenderer under points 8 and 12 of Section 95(4), in particular for a serious or repeated breach of previous public contracts or for lacking the right to submit a tender. If a previous contract was terminated early or resulted in damages or comparable sanctions, the tenderer must describe the circumstances and may provide evidence of measures taken to restore its reliability. The tenderer must also confirm that it will not use a subcontractor who would have to be replaced under Section 122(7) of the Act.

The tenderer’s combined net turnover for the last three financial years completed by the start of the procurement must be at least EUR 900,000. The tenderer must provide figures for 2023, 2024 and 2025 and, at the contracting authority’s request, extracts from the three latest approved annual accounts. Joint tenderers may rely on aggregated figures for requirements that can be combined, but each joint tenderer must submit its own annual-account extract. During the 60 months preceding the start of the procurement, the tenderer must have properly completed at least two contracts comparable to the procurement, involving reconstruction and/or installation of building automation systems. A list of the contracts must be submitted, stating the subject and brief description, signing date, completion or termination date, the other contracting party, the telephone number and email address of the client’s representative, and the procurement reference number where the contract resulted from a public procurement. At least one key person must be assigned to perform the contract. This person must hold a Level 7 diploma automation engineer professional certificate or equivalent competence, as well as Niagara 4 Technical Certification, Niagara 4 Extend/Intermediate Technical Certification and Helvar Designer Certification, or equivalent competences. The key person’s details must be submitted using Form VI together with documents proving the qualifications and competences or information enabling the contracting authority to verify them. The tender must comply with the procurement documents; conditional tenders are not permitted, and the price must be submitted in the prescribed structure and price form. Where necessary, explanations and evidence of equivalence must be included. The tenderer must identify and justify any trade secrets; the tender price and numerical figures related to evaluation may not be designated as trade secrets.
