Compliance requirements

A bidder will be excluded if the bidder or a member of its management or supervisory body, an authorised signatory, or another person with authority to represent or control the company has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies to convictions for enabling an unlawfully staying foreign national to work, violating the conditions for employing a foreign national in Estonia, including paying below the required wage, illegal use of child labour, or human trafficking. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security payment debts under the law of its country of establishment. The contracting authority may also exclude a bidder that has substantially or repeatedly breached important terms of a previous public contract, resulting in termination, a price reduction, compensation for damage or a contractual penalty. Exclusion may also result from submitting false information about compliance with qualification requirements or failing to submit required information or documents. A company established or residing in the Russian Federation or the Republic of Belarus may not participate. The bidder must confirm that none of these exclusion grounds or establishment restrictions apply.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one of them must have had a value of at least EUR 250,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, information about the other contracting parties, the client representative's telephone and email contacts, and procurement reference numbers where applicable. At the contracting authority's request, evidence of proper completion must be provided. The team must include an employee with valid switching authorisations for the switching operations required in a 0.22–20 kV electricity network. This person must be registered in Elektrilevi's partner portal before the tender submission deadline. For low-voltage works only, at least low-voltage switching authorisations are required; in other cases, both low- and medium-voltage switching authorisations are required. The team must include a person responsible for the work operation, registered in Elektrilevi's partner portal before the tender submission deadline. It must also include a person leading the electrical works who has a valid A-competence certificate and/or a qualification of at least level 6 under the Estonian Occupational Qualifications Act, holds the relevant evidence when submitting the tender, and is registered in the partner portal before the deadline. The tender must comply with all tender document conditions; conditional tenders or tenders containing additional conditions are not permitted. The tender must include a completed price table with all unit-price fields filled in and must take account of the completion instructions for management system document V178. The bidder must provide the details of the contract signatory or signatories and the contact person for contract performance; if the signatory's authority does not arise from the articles of association, a power of attorney must be included. Any business secrets must be identified and justified, but the tender price and prohibited price-related indicators may not be classified as business secrets. Materials, equipment, goods or components manufactured in or originating from the Russian Federation or the Republic of Belarus may not be used during the works; the contracting authority may request certificates of origin. In a joint tender, a power of attorney for the joint bidders' authorised representative must be submitted.
