Compliance requirements

The bidder must confirm that neither the bidder nor its management or supervisory board members, authorised representatives, procurists or other persons authorised to represent or control it have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, terrorist financing, enabling the illegal employment of a foreign national, illegal use of child labour or human trafficking-related offences. The bidder must not have outstanding tax, payment or environmental charge debts, and awarding the contract must not breach an international sanction or a sanction of the Republic of Estonia. The bidder must confirm that none of the exclusion grounds listed in Section 95(1), points 1–5 of the Estonian Public Procurement Act apply.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or an equivalent register in its country of establishment where registration is legally required. An Estonian company must provide the relevant confirmation; a foreign bidder must submit a copy of a valid registration certificate. The bidder and, where applicable, its subcontractors must hold a valid waste management registration in Ida-Viru County or a nationwide permit for the disposal of hazardous waste, as well as a valid environmental permit issued by the Environmental Board. Copies of these permits and registrations must be submitted with the tender. The tender must include the completed price form, and the total tender price must be entered in the designated section of the procurement submission system. Conditional tenders are not allowed. Joint bidders must appoint an authorised representative from among themselves and include a power of attorney. If subcontractors are used, the bidder must submit the subcontractor’s consent and a completed list of subcontractors.
