Compliance requirements
The bidder must not be subject to exclusion grounds, including a final conviction within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or illegal employment of children or trafficking in human beings. The bidder must also have fulfilled its tax and social security payment obligations. Exclusion may additionally apply where the bidder has enabled the employment of a foreign national staying without a legal basis or paid wages below the legally required rate, or where awarding the contract would violate an international or Estonian sanction. Where an exclusion ground exists, the bidder may, where permitted by the tender documents, submit evidence of measures taken to restore its reliability. If subcontractors are used, the contracting authority will also check their exclusion grounds.
Qualification criteria and exclusion grounds
The bidder must have completed at least two contracts for the renewal or construction of children's playgrounds during the last 60 months, with a combined value of at least EUR 20,000 excluding VAT. For each contract, the ESPD must include the value, contract date, a brief description of the subject matter, and the name and contact details of the other contracting party; the procurement reference must also be provided for public contracts. Confirmation letters from the clients may be added to speed up the verification. If subcontractors are used, their share of the total contract value must be stated in Procurement Documents Form 3, their consent must be submitted using Form 4, and a separate ESPD must be completed where the bidder relies on their capacity. The tender must contain all required documents and forms. If the signatory's authority is not derived from law or verifiable in public registers, a power of attorney using Form 1 must be submitted. Joint bidders must appoint an authorised representative, submit the power of attorney using Form 2, and are jointly and severally liable for contract performance. The tender price must be submitted using Form 6 in euros, both excluding and including VAT, with two decimal places. Every line of the price table must be completed, and the price must include all costs necessary to perform the contract, including taxes, duties, overheads and profit. The tender must comply with the procurement documents; where an equivalent solution is offered, its equivalence must be explained and the required evidence provided.
