Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply to the bidder, its management or supervisory body members, procurator, or other legal representatives. These grounds include convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment, unlawful use of child labour or trafficking in human beings, outstanding tax or social security payments, and being subject to an international sanction. The contracting authority may also exclude a bidder for breaches of environmental, social or labour-law obligations, bankruptcy or liquidation, serious professional misconduct, anti-competitive conduct, an unresolved conflict of interest, serious breach of a previous public contract, false information or failure to submit required documents, attempts to influence the authority or submission of misleading information, tax-related offences, or lack of the right to submit a tender. The bidder must provide confirmations that no mandatory or discretionary exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 250,000 in each of the last three completed financial years. Extracts from the annual accounts must be submitted as evidence, unless the data of an Estonian-registered legal entity are publicly available to the contracting authority through a register. At least six months must have elapsed between the end of the latest financial year and the tender submission date. During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one contract must have had a value of at least EUR 80,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the contracting party’s representative and contact details, and procurement reference numbers where applicable. The contracting authority may also request evidence of proper performance. The bidder must have an employee with valid switching authorisations for the relevant operations in a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person responsible for the work operation, registered in the same portal by that time. The person directing the electrical works must hold valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act, together with corresponding evidence, and must also be registered in the portal before tenders are opened. The tender must comply with all tender document requirements; conditional tenders or tenders containing additional conditions are not permitted. The bidder must submit a fully completed price table with all unit-price fields, evidence of the signatory’s authority to represent the bidder or, where necessary, a power of attorney, and the contact details of the person responsible for contract-performance matters. Materials, equipment and goods originating from Russia or Belarus may not be used in the works, and the contracting authority may request certificates of origin. The bidder’s place of residence or establishment may not be in Russia or Belarus.
