A bidder will be excluded if any of the exclusion grounds set out in Section 95(1) of the Public Procurement Act apply. These grounds are also checked for any entity whose resources the bidder relies on to demonstrate its qualifications. The bidder must confirm that no such grounds apply and, if the answer is negative, describe the applicable grounds. A bidder, joint bidder or qualification-providing entity whose registered or permanent place of residence is in the Russian Federation or the Republic of Belarus may not participate. For a joint tender, a power of attorney and confirmation of joint and several liability must also be submitted.

The bidder’s annual net turnover in the design sector must have been at least EUR 80,000 in each of the last three financial years completed by the start of the procurement. If the financial year coincides with the calendar year, the relevant years are 2025, 2024 and 2023. This must be demonstrated using Form 1. During the 36 months preceding publication of the contract notice, the bidder must have performed at least one similar design contract as the main contractor. The contract must concern a building, part of a building or a building complex with at least 300 m² of enclosed net floor area, and the design must have been completed at least to the detailed design stage. It must include at least the architectural, structural, building services, electrical installations and fire safety disciplines. The contract does not have to be fully completed, but the required minimum scope must have been performed. Form 1 must include the contract partner’s name and contact details, the project, designed floor area, contract period and, where applicable, the procurement reference number. The team must include a project manager holding at least a Level 7 chartered building engineer qualification, specialising in building construction, with competence in design management or preparation of building design documentation, or an equivalent qualification. The team must also include a high-voltage specialist with the required Class B competence certificate including the right to perform design work, or an appropriate Level 7 electrical engineer qualification, and a heating, ventilation and cooling specialist with at least a Level 7 chartered heating, ventilation and cooling engineer qualification including competence in designing indoor climate systems. Initial qualifications based solely on education are not considered equivalent. Details of all specialists must be provided in Form 4. Qualifications issued in Estonia will be checked in the public professional register; for qualifications issued abroad, the bidder must submit a copy of the qualification document and a document from a competent Estonian authority confirming its equivalence. If the high-voltage specialist is qualified on the basis of a competence certificate, a copy of that certificate must also be submitted. The tender must comply with all procurement document requirements. The bidder must submit Form 2, the total works price under Form 3 excluding VAT, and the same amount in the procurement register’s evaluation sheet. Only the blank total-price field in Form 3 may be completed; other fields and formulas must not be changed. Confidential documents must be separately marked, listed and justified. Where relevant, explanations and evidence of equivalence must be provided.
