Compliance requirements
The bidder may be excluded if it, or a person in its management, administration or supervisory bodies or authorised to represent, control or make decisions for it, has a final conviction within the previous five years—or remains subject to an exclusion period—for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Where permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion grounds also include breaches of tax or social security payment obligations, enabling a foreign national without legal grounds to stay in the country to work, or allowing violations of the applicable employment conditions, and circumstances in which awarding the contract would breach an international or Estonian government sanction. The notice sets the debt threshold at EUR 0; under the stated Estonian rules, a tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been rescheduled. The applicable rules of the bidder’s country of establishment apply to foreign bidders.
