Compliance requirements

A bidder will be excluded if the company or a member of its administrative, management or supervisory body, its procurist, or another person authorised to represent or control it has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering or terrorist financing. Exclusion also applies to convictions for unlawfully enabling an illegally residing foreign national to work or breaching the conditions for a foreign national’s employment in Estonia, including paying wages below the legally required rate, as well as convictions related to illegal child labour or human trafficking. The bidder must not have outstanding national tax, payment or environmental charge debts, or tax or social security debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of an earlier public contract, termination, a price reduction, damages or a contractual penalty, or for submitting false information or failing to submit required information or documents. Companies established in the Russian Federation or the Republic of Belarus may not participate. The bidder must confirm that it is not established in either country and that the materials, equipment, goods and components used in the works are not produced in or originating from either country; certificates of origin may be requested.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, information about the other contracting parties, telephone and email details of the client’s representative, and the procurement reference numbers where applicable. Upon request, the bidder must provide evidence of proper completion. The team must include a person with the switching rights required for work on a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. For work limited to 0.22–1 kV, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where medium-voltage switching is needed to perform low-voltage work. The team must also include a person responsible for the work operation, registered in the same portal before the tender submission deadline. The person managing the electrical works must hold, at the time of tender submission, a valid A-level competence or a qualification corresponding to at least level 6 under the Qualifications Act, together with the relevant certificate, and must be registered in Elektrilevi’s partner portal before the tender submission deadline. The tender must include a properly completed price table with all unit-price fields filled in; conditional tenders or tenders that differ from the procurement documents are not permitted. The bidder must provide the details of the contract signatory and the contact person for contract performance, and a power of attorney must be included where necessary. The bidder must identify and justify any trade secrets, but may not classify the tender price or numerical figures related to evaluation as trade secrets.
