Compliance requirements
The tenderer must confirm that none of the exclusion grounds apply to the tenderer or its relevant representatives. These grounds include final convictions within the last five years or a continuing exclusion period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. Exclusion may also apply for breaches of tax or social security payment obligations, insolvency, bankruptcy, liquidation, an agreement with creditors, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing this procurement, serious or repeated breaches of previous contracts, submission of false or missing information, failure to provide requested documents, or attempts to obtain confidential information or improperly influence the contracting authority. The tenderer must also not have breached environmental, social or labour-law obligations, enabled the employment of unlawfully present foreign nationals, be subject to an international sanction, or have relevant convictions for tax offences. Tax and social security payment obligations are assessed against a threshold of 0 EUR; under Estonian rules, a tax debt certificate is generally not issued where the debt is below 100 EUR or payment has been deferred. Where legally permitted, the tenderer may provide evidence of remedial measures restoring its reliability.
Qualification criteria and exclusion grounds
The tenderer may submit a bid for up to four lots, and contracts may be awarded to one tenderer for up to four lots. The bid must be unconditional and must confirm compliance with all tender documents. The price must be submitted in the required pricing form and in the procurement system's pricing structure; it must include all materials, labour, taxes, duties and other costs necessary for proper performance of the framework agreement, excluding VAT. Unit prices are final for the entire contract period, except for changes in the VAT rate. The tenderer must provide a completed technical description and compliance table, a technical specification enabling verification against every requirement, and all documents required by the technical description. At least one suitably qualified medical equipment specialist who has completed manufacturer training must be included in the team; the bid must contain the specialist list and the manufacturer's training certificate. The tenderer must provide evidence that the offered equipment and compatible consumables are authorised for use in EU countries and comply with EU requirements, including a declaration of conformity, instructions for use, product or packaging markings and, where applicable, an EC certificate of conformity. Original manufacturer instructions in English, including service and repair manuals, must be supplied electronically with the bid and on paper upon delivery. Estonian methodology, operating, maintenance and safety instructions must be supplied electronically and on paper upon delivery. A list of high-value spare parts is also required. The bid must include the contract signatory's and contact person's details and, where applicable, a power of attorney. For a joint bid, the joint tenderers must appoint an authorised representative and submit the relevant power of attorney. The tenderer must identify any trade secrets and justify their designation; the bid price and other specified price-related evaluation figures may not be classified as trade secrets. The tenderer must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers connected with the Russian Federation as described in the EU sanctions rules, and that the offered goods are not sanctioned goods or from sanctioned territories. Equivalent products and evidence may be used where permitted, but equivalence must be explained and documented.
