Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded for relevant final convictions within the previous five years involving the bidder or its directors, managers, supervisory body members or authorised representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Grounds also include breaches of tax or social security payment obligations; tax arrears below EUR 100 are not treated as evidenced arrears under the stated Estonian rules, and scheduled payments are noted as an exception. Other grounds include breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets by a liquidator or court, suspended business activity or a similar situation; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; involvement in preparing the procurement where the resulting competitive advantage cannot otherwise be eliminated; and serious or repeated breach of an earlier contract resulting in early termination, damages, a price reduction or a penalty. Exclusion may also follow from false or misleading information, failure to provide required information or supplementary documents, or improper attempts to influence the procurement or obtain confidential information. National grounds include enabling the unlawful employment of a foreign national, being subject to an international or Estonian government sanction, relevant tax-crime convictions, and any restriction on the bidder’s right to participate based on its place of establishment. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bid must follow the price structure specified in the procurement’s evaluation worksheet. Conditional bids are not permitted, and submitting a bid confirms acceptance of all procurement document terms. A consortium bid must include an authorisation appointing its representative. The bidder must identify and justify any information claimed as a trade secret; the bid price and figures used in evaluating bids may not be designated as trade secrets. Where relevant, the bidder must explain equivalence and provide supporting evidence. During contract performance, the bidder may use only subcontractors and suppliers established in Estonia, another EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement. The bidder must confirm compliance with environmental requirements: deliverables should normally be provided digitally, digital files must be stored and transmitted in an appropriately limited size, unnecessary files must be deleted promptly, and products bearing a Type I ecolabel should be preferred when printing is needed. The bidder must identify authorised persons who can represent, make decisions for or control the company but are not visible in the commercial register, giving their names and personal identification codes, or confirm that there are no such persons. The bid must include a project description of no more than 35 A4 pages. It must explain the bidder’s understanding of the objectives and tasks and the links between the business analysis, MVP, STAR2 and other Mudila procurements; provide a month-by-month schedule of stages, interim deliverables, coordination points with the contracting authority and final deliverable deadlines; describe the methodology for analysing and validating user needs, data needs, the STAR2 target architecture and the MVP, including how objectives will be achieved with reasonable effort and resources; describe cooperation with the contracting authority and other stakeholders; and include a risk analysis. Content beyond 35 pages will not be assessed. The project description is evaluated under the corresponding award criterion. The team must cover project management, business analysis and UX/UI design; one person may perform more than one role. The project manager or at least one team member must have experience, gained during the five years preceding the start of the procurement, in conducting information-system business analysis or service-design work. At least one team member must have experience, gained during the same five-year period, in developing an MVP or prototype, or conducting user testing. A free-form CV must be provided for each team member, showing education, work experience and relevant competence and experience. The bid must also name the team members and describe their roles, division of work and responsibilities, explaining the team’s suitability and how members’ competencies complement one another. Team composition and experience are evaluated under the corresponding award criterion. The notice specifies no particular turnover threshold.
