Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded for specified criminal convictions of the company or its representatives, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be addressed; and significant or repeated failures under earlier contracts resulting in early termination, damages, price reduction or penalties. A bidder may also be excluded for breaches of environmental, social or labour obligations, false or misleading information, withholding required information or documents, attempts to improperly influence the procurement or obtain confidential information, certain tax offences, unlawful employment of foreign nationals, or a contract that would breach international or national sanctions. The notice identifies tax and social contribution arrears with a threshold of EUR 0; applicable rules may treat debts below EUR 100 or debts covered by a payment schedule differently. Where legally available, the bidder may submit evidence of remedial measures to demonstrate restored reliability.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least one contract for the sale of similar goods—weatherproof jackets and trousers—during the 36 months before the procurement began. The contract must have a value of at least EUR 50,000 excluding VAT. The bidder must provide a list of the completed contracts, including dates, value excluding VAT and the customer’s details; the customer may be asked to confirm proper performance. Where relying on another entity’s resources, the bidder must provide that entity’s commitment to make the resources available and perform the relevant part of the contract, together with its European Single Procurement Document (ESPD). The bid must comply with the tender documents and may not be conditional. The bidder must submit at least one jacket and one pair of trousers in the specified base sizes, as well as fabric colour samples of at least 4 × 4 cm for each proposed main material in Dark Navy, Olive Night and Safety Yellow. Samples must be made from the materials proposed for production and meet the stated construction, functional, quality, marking and other technical requirements. They must be delivered to Pärnu mnt 139, Tallinn, before the bid submission deadline; late or missing samples result in rejection. Samples must be packed in a sealed, opaque package, without bidder-identifying marks on the products, and the package must bear the specified bidder, buyer and tender details. The bidder must also submit full product and material specifications, manufacturer information, the required test reports and standards evidence, a drawing of the marking label, and a completed sample-cost form. Technical documents must be in Estonian or English; material and accessory specifications must be issued or confirmed by the manufacturer and be no more than three years old at the start of the procurement. The buyer pays for compliant samples. The bid must also follow the prescribed price structure, explain any claimed trade secrets, and include an authorisation if submitted jointly. Equivalent products or evidence may be offered where permitted, with equivalence explained and supported by evidence. The bidder must confirm that the goods are not subject to international sanctions or from sanctioned regions, and that Russian-linked subcontractors or suppliers will not account for more than 10% of the contract value.
