Compliance requirements

The bidder must confirm that neither it nor its representatives or members of its management or supervisory bodies have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. The exclusion grounds also cover tax or social security arrears, breaches of environmental, social or labour law, bankruptcy or insolvency proceedings, agreements with creditors, liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, and serious or repeated breaches or early termination of previous contracts. The bidder must not submit false information, omit required information or documents, or attempt to improperly influence the contracting authority's decisions. The bidder must also confirm that the relevant national exclusion grounds do not apply, including unlawful employment of foreign nationals, international sanctions and tax offences. In applicable cases, evidence of measures taken to restore reliability may be submitted. The bidder must additionally confirm that its registered or permanent residence is not in the Russian Federation or Belarus and that sanctioned persons are not used in a prohibited manner.

Qualification criteria and exclusion grounds

Within the 36 months preceding publication of the contract notice, the bidder must have properly provided at least three technical maintenance services for buildings with a closed net area exceeding 500 m². For each reference, the bidder must have carried out all maintenance activities covered by EVS 807 codes 281, 282, 283 and 284. The ESPD must include a list of the contracts with the contracting party's name and contact details, the site address, the contract validity period and, where the contract resulted from a public procurement, the procurement reference number. At the contracting authority's request, the bidder must provide confirmation from the previous client that the services were performed properly and to the required extent. The services must be performed with a project manager who has at least secondary education and, during the last three years, has managed technical maintenance work for at least two buildings with a closed net area exceeding 500 m², for at least six months on each site, or who holds at least a level 5 professional certificate as a responsible security systems specialist with the competence for installing and maintaining fire alarm systems, or an equivalent qualification. The project manager's responsibility for performing similar contracts must, if requested, be demonstrated by a client confirmation, contract or other document signed by the client. Details of the specialists must be submitted on Form 4 together with proof of education. For qualifications obtained abroad, the bidder must provide a copy of the qualification document and confirmation from a competent Estonian authority that the foreign qualification meets the required standard. The bidder must submit the participation application on Form 2, the price table on Form 3 and, where applicable, a list of documents protected as trade secrets with reasons. Prices must be provided separately for each lot in euros, excluding VAT and including the reserve; all fields in Form 3, including the hourly rate, must be completed, and the hourly rate must remain within the specified limits. Cross-subsidisation and zero pricing are prohibited, and fixed prices for additional services may not exceed the maximum amounts stated in the table. The tender must comply with the procurement documents; any proposed equivalent must be explained and supported by the necessary evidence. For a joint tender, a power of attorney and confirmation of joint and several liability must be submitted on Form 8.
