The contracting authority will exclude a bidder if the bidder or a person authorised to represent, manage or control it has a relevant conviction for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the illegal employment of foreign nationals or breaches of their employment conditions, including underpayment; or unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding state taxes, duties or environmental charges, or tax or social security contribution arrears under the law of its country, or where awarding the contract would breach an international or Estonian government sanction. The bidder must confirm that none of these grounds applies.

The bidder must be entered in the commercial register of its country of establishment where registration is required by that country’s law. A bidder established in Estonia does not have to submit a copy of its register entry. The bidder and/or its subcontractor must have properly performed at least one similar contract during the 60 months before the procurement began. The contract must have covered both the design of a thermal insulation solution for industrial equipment and the performance of thermal insulation works. The bidder must submit Form 2, listing the contract name, a brief description, performance period and other contracting party. If the bidder relies on another company’s experience, that company must be listed as a subcontractor and must personally perform the relevant part of the contract. Throughout the contract period, the bidder must have available the capacity and appropriate calculation tools needed for thermal calculations, a designer for the design work, and a person responsible for installation work. The bid must comply with the tender documents; conditional bids are not permitted. Prices must follow the structure specified in the pricing schedule, and Form 1 must be completed in all highlighted fields without deleting rows. Joint bidders must appoint an authorised representative and provide the relevant authorisation. Where equivalence is claimed, the bidder must explain it and provide supporting evidence. The bidder must identify and justify any trade secrets, while not treating the bid price or other specified evaluation figures as trade secrets. The bidder must disclose known circumstances that could create a conflict of interest or an unfair competitive advantage and provide an explanation with the bid if such circumstances exist.
