Compliance requirements
The bidder must declare whether it or its relevant representatives have final convictions within the applicable period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, or have been punished for enabling unlawful employment of a foreign national. Exclusion may also apply for unpaid taxes or social security contributions; environmental, social or labour-law breaches; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremediable competitive advantage; significant or repeated failures under earlier contracts resulting in termination or sanctions; false or misleading information, withheld information, failure to provide requested documents, or attempts to obtain confidential information or improperly influence the procurement. The notice also provides for exclusion relating to international sanctions, certain tax offences, local tax arrears where applicable, and restrictions on participation based on the bidder’s location. The bidder must confirm that it is not established in Russia or Belarus and does not rely on the resources of such an entity. It must also confirm that it will not use subcontractors or suppliers covered by the stated Russia-related restrictions for more than 10% of the contract value. Where the applicable rules allow it, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must meet these qualification and compliance requirements:
- Financial capacity: net turnover of at least EUR 500,000 in each of the last two financial years that had ended by the start of the procurement. Provide the figures in the ESPD; if they are not publicly available to the contracting authority, submit the requested annual-report extracts or other evidence of turnover.
- Experience: at least three properly performed contracts during the 36 months before the contract notice was published. Each must cover maintenance of ventilation and air-conditioning systems in a building with more than 3,000 m² of closed net floor area, for at least six consecutive months, and include maintenance activities under EVS 807 codes 244 and 245. Contracts need not be completed if the required six months have been performed. Provide descriptions, values, dates and client details, including contact information; framework agreements may be evidenced by completed call-off contracts.
- Fluorinated greenhouse gases: provide a copy of a permit to handle products, equipment and systems containing fluorinated greenhouse gases, or an equivalent permit.
- Personnel: before contract award, provide details of the required specialists. The project manager must have at least upper-secondary education, Estonian language skills at C1 level, and, during the three years before publication of the notice, experience leading maintenance of ventilation and air-conditioning systems in at least two buildings exceeding 1,000 m², with at least six months of leadership work at each. One specialist/foreman must hold at least a Refrigeration Mechanic level 4 qualification or equivalent, have at least two years’ experience and Estonian at B2 level. Another specialist/foreman must hold a B-level electrical competency certificate, have at least two years’ experience and Estonian at B2 level.
- The bid must comply with the tender documents, use the required price-offer structure and may not be conditional. Explain and evidence equivalence where applicable. For a joint bid, appoint an authorised representative and include the power of attorney. Identify any trade secrets and justify their designation; the price and other specified evaluation figures may not be treated as trade secrets. Provide the names and personal identification codes of authorised or controlling persons not visible in the procurement register, or confirm that there are none.
