Design of a city park container toilet and its electrical, water supply and wastewater sewerage systems

The bidder must confirm that no exclusion grounds apply to the company, its management or supervisory board members, representatives or controlling persons. The checks cover, among other matters, final convictions within the last five years or an ongoing exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the unlawful use of child labour or other forms of human trafficking. The bidder must also have no outstanding taxes or social security contributions and must not have breached rules concerning the employment of unlawfully resident foreign nationals. Awarding the contract must not breach an international sanction or a sanction imposed by the Government of the Republic. Where relevant, the bidder must provide details of the conviction, exclusion period and measures taken to restore its reliability, together with relevant evidence. The bidder must be able to provide proof of tax and social security payment or information allowing the contracting authority to verify it.

The bidder or joint bidders must have properly completed at least two similar design contracts during the 36 months preceding the start of the procurement, with a combined value of at least EUR 16,000. The ESPD must include the value of each contract, a brief description of the work, the contract date, the details of the other contracting party and, where applicable, the procurement reference number. Client confirmation letters may also be submitted. The team must include at least a level 7 qualified water supply and sewerage engineer with competence in designing external water supply and sewerage systems, and a level 6 qualified electrical engineer with design competence. Details of these specialists and their professional certificate numbers must be provided; if the information cannot be found in the professional register, copies of diplomas or professional certificates must be attached. If subcontractors are used, their share of the total contract value must be stated on Form 3, the subcontractor’s consent must be submitted on Form 4, and a separate ESPD must be completed for any subcontractor whose capacity is relied upon. The bid must be unconditional, submitted in the required format and contain all required documents and forms. If the signatory’s authority is not based on law, a power of attorney using Form 1 must be included. For a joint bid, a power of attorney for the joint bidders using Form 2 must be included, and the joint bidders are jointly and severally liable for contract performance. The price must be submitted on Form 6 in euros, both excluding and including VAT, with two decimal places in each case, and must cover all costs necessary for contract performance, including taxes, duties, overheads, profit and works not expressly described but necessary according to good practice. If an equivalent solution is offered, its equivalence must be explained and supporting evidence must be provided.
