Compliance requirements
The bidder must confirm that neither the company nor its management, representatives or controlling persons has been finally convicted within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, terrorism-related offences, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also confirm that there are no applicable grounds relating to unpaid taxes or social security contributions, breaches of environmental, social or labour law, bankruptcy, insolvency, liquidation, agreements with creditors, comparable domestic proceedings, administration of assets by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of previous public contracts, submission of false or incomplete information, failure to provide required documents, or attempts to obtain confidential information or improperly influence the contracting authority. The bidder must additionally confirm that entering into the contract would not breach international or Estonian sanctions and that it has not enabled an unlawfully staying foreign national to work. Where an exclusion ground applies, the bidder may, where legally permitted, submit evidence of remedial measures demonstrating its reliability. For first-tier subcontractors, the contracting authority will check the listed exclusion grounds during contract performance; second- and subsequent-tier subcontractors are not checked under the stated procedure, and subcontractors are not required to submit a separate European Single Procurement Document. The bidder must not use a subcontractor who would have to be replaced under the applicable public procurement rules.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment where such registration is legally required. A foreign bidder must provide, upon request, equivalent proof of registration. The bidder’s average annual net turnover during the completed financial years from 1 January 2023 to 31 December 2025 must be at least EUR 1,300,000. The bidder or consortium must have a team consisting of a design project manager qualified at least as a Level 7 Chartered Construction Engineer, or equivalent under the European Qualifications Framework, specialising in design management for building construction; a construction project manager with at least the same qualification level and specialisation in construction management for building construction; and a construction site manager qualified at least as a Level 6 Construction Engineer, or equivalent, specialising in construction management for building construction. One person may fulfil more than one role if all requirements for each role are met. The bidder must provide the specialists’ names in the European Single Procurement Document and, where requested, copies of their professional certificates. If a specialist is not the bidder’s or consortium member’s employee, the bidder must rely on that person’s capacity and submit the required European Single Procurement Document and other information for that person; the exclusion grounds will also be checked. Within the 60 months preceding the start of the procurement, the bidder or consortium as a whole must have completed at least one contract as main contractor for the construction of a public-use building with a closed net floor area of at least 1,200 m². The contract must have been properly performed. The bidder must list the relevant contract, including the building’s characteristics, dates, contracting party and other required reference information. The offer must comply with the tender documents and may not be conditional. The price submission must follow the prescribed structure, all blank cells in the cost schedule must be completed with figures, and the design cost line may not exceed 10% of the total tender price. The bidder must include all studies, approvals, permits, materials, storage, labour, equipment and ancillary work necessary to complete the works unless stated otherwise. If equivalent products, standards or evidence are offered, their equivalence must be explained and supported by evidence. Joint bidders must submit a power of attorney identifying the lead bidder and confirming joint and several liability. The bidder must identify any trade secrets and justify that classification. It must also confirm that the furniture wood, if supplied under the procurement, comes from legal sources, declare REACH candidate substances exceeding 0.1% by mass, provide disassembly and repair instructions, offer at least a two-year warranty from delivery, and ensure spare parts or functionally equivalent components for at least two years after delivery.
