Compliance requirements
The bidder must not be subject to the exclusion grounds set out in § 95(1), points 1–5, and § 95(4), point 12 of the Estonian Public Procurement Act. The bidder must confirm that these grounds do not apply. They include, among other matters, participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal use of child labour and human trafficking, unpaid taxes or social security contributions, enabling an unlawfully staying foreign national to work, and situations in which contract award would breach an international or Estonian sanction. Where necessary, the bidder must also provide information about persons not visible in the commercial register who are authorised to represent, control or make decisions for the bidder.
The bidder must not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons, or representatives of or persons acting on the instructions of such persons. The bidder must also confirm that any goods offered are not subject to international sanctions and do not originate from sanctioned regions. Where subcontractors are used, the bidder must confirm that no exclusion grounds apply to them.
Qualification criteria and exclusion grounds
The bidder’s total turnover from all business activities must have been at least EUR 600,000 in each of the last three completed financial years. The bidder must provide turnover data for those three financial years and, if requested by the contracting authority, annual reports or extracts from them. If the bidder relies on another entity’s resources, it must submit the consent required by Annex 4, stating the turnover amount available, the commitment to provide financial resources when needed and joint responsibility for proper contract performance. Where a joint tender relies on the resources of another joint tenderer, the tender must describe the size and nature of the contract part to be performed by each member. If a foreign entity participates, extracts from its annual accounts or other documents enabling verification must be submitted.
The tender must include a description of the process for providing mooring services at Paldiski South Harbour, covering the safe receipt, fastening to bollards and release of mooring lines. Copying the technical description is not sufficient. The bidder must provide at least four mooring crew members for every vessel of at least 80 metres and state the number of crew members in the tender. The mooring crew supervisor must have accumulated at least one year of experience in vessel mooring and/or managing a mooring team during the 10 years preceding publication of the contract notice; the supervisor’s details must be submitted using Annex 3. The crew must be able to reach the quay within no more than 60 minutes after receiving an order from the vessel traffic supervisor, and the proposed time must be stated to the nearest minute.
The bidder must confirm that the tender complies with all tender document requirements; conditional tenders are not permitted. The work must be performed in an environmentally responsible manner, including separate waste collection, recycling and, where possible, the use of environmentally friendly equipment. A joint tender must include the power of attorney required by Annex 5. If subcontractors are used, they must be identified in the tender and their signed consent under Annex 6 must be submitted; at the start of contract performance and whenever an additional subcontractor is engaged, the bidder must provide the subcontractor’s name, registration number, contact details and information about its legal representatives.
