Compliance requirements
The bidder must confirm that no mandatory exclusion ground applies. These include relevant convictions involving organised crime, corruption, fraud, terrorism, money laundering or terrorist financing, unlawful employment of foreign nationals or breaches of their employment conditions, child labour or human trafficking; outstanding tax, social security or environmental charge debts; and a contract that would breach an international or Estonian government sanction.
The contracting authority may also exclude a bidder that is insolvent or in liquidation, has committed serious professional misconduct, engaged in anti-competitive conduct, has an unmanageable conflict of interest or an unfair advantage arising from involvement in preparing the procurement, seriously or repeatedly breached a previous public contract, provided false or misleading information or sought confidential information improperly, has committed tax-related offences, or is not legally entitled to submit a bid. A bidder may also be excluded for breaching any participation restriction based on its place of establishment set out in the tender documents.
Qualification criteria and exclusion grounds
For each lot bid for, the bidder’s average annual net turnover over the last three completed financial years must be at least €40,000. The thresholds are cumulative across lots: for example, at least €80,000 for two lots and €240,000 for all six. If the bidder has operated for fewer than three completed financial years, the average is calculated over its completed years of operation. Comparable operating revenue may be used where net turnover is not applicable. The bidder must provide turnover information; supporting accounts or other evidence must be submitted if the information is not freely available electronically.
For each lot bid for, the bidder must have properly delivered at least one similar training course during the 36 months before publication of the contract notice. The bidder must provide the course name and brief description, delivery period and the client’s contact details. The client’s confirmation may be submitted with the bid or provided later at the contracting authority’s request.
Trainer requirements depend on the lot. For lot 1, the team must include at least one lecturer with an ITIL Expert certificate or evidence of equivalent competence. For lot 2, at least one lecturer must hold Microsoft Certified Trainer certification or demonstrate equivalent competence. For lots 3–6, every lecturer must have at least one of the following: higher education in IT; vocational education in IT; or an adult educator qualification at level 5 or equivalent, together with experience delivering similar IT training during the 24 months before publication of the contract notice. Submit evidence of the required education or professional qualification and, where the third option is relied on, a description of the relevant training experience.
For every lot bid for, complete the applicable frequently ordered services table for all listed courses. Include each course’s name, duration in academic hours, brief description and delivery location, maximum price per person excluding VAT, minimum discount for groups of 2–5 and groups of 6 or more, and the minimum discount from the website price for other open courses not listed. An incomplete table may result in rejection. The bid must accept the tender-document requirements without conditions; explain any claimed equivalence and provide supporting evidence. Joint bidders must appoint an authorised representative and provide an authorisation. Identify and justify any claimed trade secrets, but do not classify prices or other evaluation-related numerical figures as trade secrets. No award criteria are specified in the provided documents.
