Compliance requirements
The bidder must confirm that none of the exclusion grounds set out in Section 95(1), points 1–5, and Section 95(4), point 12 of the Estonian Public Procurement Act apply. These include, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, the use of child labour and other forms of trafficking in human beings, breaches of tax or social security payment obligations, enabling an unlawfully present foreign national to work, and breaches relating to sanctions. The confirmation must be submitted in the public procurement register.
The bidder must also identify any persons authorised to represent, make decisions for or control the company who are not visible on the company’s registry card available to the contracting authority. The person’s name and personal identification number must be provided, or the bidder must confirm that no such persons exist.
The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from a sanctioned region. In addition, the bidder may not involve subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons or entities, or representatives of, or persons acting on the instructions of, such persons or entities. A bid may be rejected if this requirement is breached.
First-tier subcontractors will be checked when contract performance begins. Subcontractors do not have to submit a separate European Single Procurement Document, but each subcontractor must confirm that none of the exclusion grounds specified in the tender documents apply to it.
Qualification criteria and exclusion grounds
The tender is divided into two lots. Lot 1 covers mooring services at berths 1–8 in the south-eastern part of Tallinn Old Harbour, while Lot 2 covers mooring services at berths 9–27 in the north-western part.
- For Lot 1, the bidder’s total turnover from all business activities must have been at least EUR 700,000 in each of the last three completed financial years.
- For Lot 2, the corresponding minimum turnover is EUR 800,000 in each of the last three completed financial years.
- If a bidder submits a bid for both lots, the turnover thresholds are not added together; the higher applicable threshold takes priority.
- The bidder must provide turnover data for the last three completed financial years. If the information is not available from a public database, the bidder must provide annual accounts or extracts upon request.
- If the bidder relies on another entity’s resources, it must submit the consent required by Annex 4, stating the amount of turnover available, any commitment to provide financial resources and joint responsibility for proper contract performance. Joint bidders must, where applicable, describe the size and nature of the contract share performed by each member.
- The bid must include a process description for the relevant mooring service. It must explain how mooring operations are organised, including the safe receipt, fastening to bollards and release of ships’ mooring lines; merely copying the technical description is insufficient.
- The bidder must ensure the presence of at least four quay crew members whenever a vessel of at least 80 metres in length is moored, and must state the proposed number of quay crew members in the bid.
- Throughout the framework agreement, the bidder must provide a quay crew supervisor with at least one year of combined experience, acquired during the ten years preceding publication of the contract notice, in participating in vessel mooring and/or managing a mooring team. The experience may consist of accumulated periods, and the supervisor’s details must be submitted using Annex 3.
- In the event of a failure of the automatic mooring equipment, the quay crew must be able to arrive at the berths within 30 minutes. The bidder must state the arrival time in minutes to the nearest minute.
- The bid must be unconditional and comply with the tender documents. The bidder must confirm environmentally responsible performance, including separate waste collection, recycling and, where possible, the use of environmentally friendly equipment.
- If a subcontractor is used as quay crew or as the supervisor, the subcontractor must be identified in connection with the bid and its signed consent under Annex 6 must be submitted. At the start of contract performance and whenever a new subcontractor is added, the names, registration numbers, contact details and legal representative information of first-tier subcontractors must be provided.
