Compliance requirements

The bidder must confirm that the bidder, its management or supervisory body members, representatives and controlling persons have not been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Grounds for exclusion may also include tax or social security debts, breaches of environmental, social or labour law, bankruptcy, liquidation or other insolvency, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, an unresolved conflict of interest or improper involvement in preparing the procurement. A material or persistent breach of a previous public contract resulting in early termination, damages or sanctions may also be relevant, as may false statements, withheld information or failure to provide requested documents. The national exclusion grounds additionally cover enabling an unlawfully staying foreign national to work in Estonia, the application of international or national sanctions and convictions for tax offences. Where an exclusion ground exists, the contracting authority may, where applicable, assess measures taken to restore the bidder’s reliability. The bidder must be able to provide proof of payment of taxes and social security contributions, or information enabling the contracting authority to verify this directly.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise requirements concerning turnover, previous experience, personnel or other selection criteria; these must be checked in the tender documents. The bidder must submit the European Single Procurement Document and confirm that the bid complies with all conditions set out in the tender documents. Conditional bids are not allowed. The bid price must be submitted using the structure specified on the page for award criteria and measurable values.
