The bidder must confirm that none of the exclusion grounds under § 95(1), points 1–3 and 5, of the Estonian Public Procurement Act apply. The bidder must not be bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, have suspended business activities or be in an equivalent situation under the law of its country of establishment. The bidder must have no outstanding state taxes, duties, environmental charges or social security contributions under the law of its country of establishment; a foreign bidder must provide evidence for verification. The bidder must also confirm that concluding the contract would not breach an international sanction or a sanction imposed by the Government of the Republic. In a joint tender, these requirements apply to every joint bidder.

The bidder must submit a tender that complies with all requirements set out in the procurement documents. Conditional tenders are not permitted. If an equivalent product, standard, label or other solution is offered, the bidder must explain the equivalence and provide supporting evidence where necessary. The tender must be submitted by the bidder’s legal or authorised representative. If submitted by an authorised representative who is not recorded as having statutory representation rights in the Estonian commercial register, a power of attorney must be provided. If the bidder is not the manufacturer of the offered front loader, it must provide the manufacturer’s original authorisation, or a notarised copy, confirming the right to market the goods in Estonia. The bidder must also submit the manufacturer’s technical specification for the offered goods, including the relevant parameters and technical data, together with drawings. The notice does not specify financial turnover or previous-experience requirements.
