Compliance requirements
The bidder and persons involved in its management or control must confirm that no exclusion grounds apply, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, unlawful use of child labour or human trafficking. The bidder must also have no tax or social security debt, bankruptcy, liquidation or other insolvency situation, suspended business activity, serious professional misconduct, agreements restricting competition, unavoidable conflict of interest, or previous material contractual breach resulting in early termination, damages or another sanction. Exclusion may also result from submitting false information, failing to provide required information or documents, improperly influencing the contracting authority, enabling an unlawfully present foreign national to work, breaching international or national sanctions, a conviction for tax offences, local tax debt owed in the contracting authority’s location, or breach of a participation restriction. The bidder must also provide the names and personal identification codes of authorised persons not visible to the contracting authority in the relevant register, or confirm that no such persons exist. All exclusion-ground responses and any supporting evidence must be provided in the ESPD; the exact checks must be made against the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total net turnover from all business activities must have been at least EUR 400,000 in each of the last three completed financial years preceding the start of the procurement. Turnover data for each relevant year must be provided in the ESPD.
Within the 36 months preceding the start of the procurement, the bidder must have properly completed at least two urban street design contracts. Each contract must have involved the design of at least 300 metres of street, including the carriageway, utility networks and street lighting. The bidder must provide a short description of the contracts, performance periods, values, its area of responsibility, and the client and contact-person details, including the procurement reference where applicable.
The project manager responsible for managing the design work must hold a diploma-level road engineer qualification or an equivalent European Qualifications Framework qualification at least at level 7, excluding an initial qualification, with competence in design management. The project manager and road designer must be different individuals. The road designer must hold a diploma-level road engineer qualification or an equivalent European Qualifications Framework qualification at least at level 7, with competence in preparing road construction designs.
The district-heating designer must hold a thermal energy engineer qualification or an equivalent European Qualifications Framework qualification at least at level 7, specialising in district heating and district cooling systems. The designer responsible for water supply and sewerage structures must hold an authorised water supply and sewerage engineer qualification at level 8 or an equivalent European Qualifications Framework qualification, specialising in external water supply and sewerage and competent to prepare the relevant design. The landscape architecture designer must hold an authorised landscape architect qualification or an equivalent qualification at least at level 7.
Information on all named persons must be provided in the ESPD. At the contracting authority’s request, the bidder must submit documents proving their professional qualifications, including where a person works as a subcontractor. The tender must comply with all tender-document requirements; conditional tenders are not permitted. Prices must be submitted in euros excluding VAT, with unit prices shown to two decimal places in accordance with Annex 2. Every line in Annex 2 must be completed, the form may not be altered or supplemented, and zero or negative unit prices are prohibited. The price must include all costs necessary for proper contract performance. In a joint tender, a properly signed power of attorney and, where applicable, information on the part of the contract performed by each joint tenderer must be submitted.
