Compliance requirements
The bidder must confirm that neither it nor its management, supervisory body members, authorised representatives or controllers has been convicted within the last five years, or remains subject to an exclusion order, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The bidder must also confirm compliance with tax and social security payment obligations. Exclusion grounds also cover breaches of environmental, social and labour law, bankruptcy, insolvency or liquidation proceedings, arrangements with creditors, comparable national proceedings, administration of assets by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated failures under previous contracts resulting in early termination, damages or penalties, and the submission of false or withheld information or failure to provide requested documents. The bidder must also confirm that the contract would not breach international or Estonian sanctions and that no applicable national exclusion ground concerning unlawful employment of foreign nationals or certain tax offences applies. Where permitted, the bidder may provide evidence of remedial measures demonstrating its reliability.
Qualification criteria and exclusion grounds
The bidder’s average net turnover for the three completed financial years from 1 January 2023 to 31 December 2025 must be at least EUR 150,000. The contracting authority will verify the turnover in the Estonian Commercial Register and may request turnover information signed by a management board member. Within the 48 months preceding the procurement, the bidder must have completed at least two public-facing marketing or communication service contracts, each lasting at least three months. The bidder must submit a list showing the performance period and information about the other contracting parties and must provide contract details if requested. The bidder must include at least the following specialists in the service team: a project manager with experience as a project manager on a marketing or communication service contract lasting at least six months during the preceding 48 months and at least conversational proficiency in Estonian and Russian; a creative director with experience in the creative director role on at least two marketing or communication service contracts during the preceding 48 months; a designer with experience on at least two such contracts during the preceding 48 months in designing a landing page and advertising visuals for digital channels, including at least one social media channel; and a social media specialist with experience on at least two such contracts during the preceding 48 months. One person may perform up to two specialist roles. The bidder must submit the proposed team details, each member’s role and contact details, and signed specialist confirmations describing their experience, competence and consent to participate. The tender must be submitted by the bidder’s legal or authorised representative; a power of attorney is required for an authorised representative. Joint bidders must appoint an authorised representative, submit the relevant power of attorney and accept joint and several liability. The tender must include the bidder’s confirmations, a final price covering all contract-related costs, a creative concept and preliminary marketing campaign plan following the required structure, and the required team documents. Any claimed trade secret must be identified and justified, but numerical information characterising the tender and relevant to evaluation may not be classified as a trade secret. The bidder must confirm compliance with the procurement documents and explain and substantiate any claimed equivalence where applicable.
