Compliance requirements
The bidder must confirm that neither it nor its representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. Exclusion grounds also cover unpaid taxes or social security contributions, breaches of environmental, social or labour-law obligations, bankruptcy or liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. The bidder must also confirm that contract award would not breach international or Estonian sanctions, that the bidder and entities whose capacities it relies on are not established in Russia or Belarus, and that prohibited sanction-related subcontractors or suppliers will not be used. Where permitted, the contracting authority may consider remedial measures taken to restore the bidder’s reliability.
Qualification criteria and exclusion grounds
The bidder’s annual net turnover must have been at least EUR 70,000 in each of the last three financial years completed before the procurement began, namely 2023, 2024 and 2025. At the contracting authority’s request, the bidder must provide annual reports or other documents proving the turnover. Where relevant, the bidder may rely on the capacities of another entity; in that case, the other entity’s ESPD and the required undertaking concerning joint responsibility must also be provided.
During the 36 months preceding the start of the procurement, the bidder must have completed at least three equivalent contracts or assignments involving the creation and implementation of an awareness campaign. The bidder must provide descriptions, values, periods, client details and contact information for these contracts. At the contracting authority’s request, additional explanations or documents must be submitted within five working days for information that cannot be readily verified from public sources.
The tender must include a sufficiently precise and detailed creative concept proposal and communication plan description, enabling the contracting authority to assess compliance and award points under the award criteria. Copying the contracting authority’s technical description as the bidder’s own concept is not permitted. The team must include at least three specialists, including a content-creation specialist and a design specialist. The content specialist must have relevant education or equivalent qualifications in advertising, marketing, communications, journalism or another suitable field. The design specialist must have relevant education or equivalent qualifications in design, visual design or multimedia; another higher-education degree combined with relevant additional training and/or demonstrable advertising or marketing experience is also acceptable. The bidder must provide team members’ names, roles, qualifications and experience, together with documents proving the education of the design and content-creation specialists.
The bidder must describe in the tender how it will use environmentally preferable solutions, including, where possible, online meetings, digital materials, optimally sized files, deletion of unnecessary digital materials and environmentally responsible web-design principles. Campaign visual materials must be accessible to people with hearing, intellectual or visual impairments.
The tender must be submitted electronically through the public procurement register in Estonian. Foreign certificates and other documents may be submitted, but the contracting authority may request translations. The tender price must follow the prescribed structure and be stated in euros excluding VAT, to two decimal places; alternative tenders and negative prices are not permitted. Where applicable, a power of attorney for joint bidders or for the company’s authorised representative must be provided. If an equivalent solution is offered, its equivalence and supporting evidence must be explained in the tender.
