The bidder must confirm that neither the bidder nor its relevant representatives has been finally convicted within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The bidder must have fulfilled its tax and social security payment obligations. Exclusion grounds also cover agreements with creditors, bankruptcy or comparable insolvency proceedings, liquidation or court- or liquidator-controlled assets, suspended business activities, serious professional misconduct, agreements intended to distort competition, conflicts of interest, involvement in preparing the procurement that creates an advantage, and serious or repeated breaches of previous public contracts resulting in early termination, damages or comparable sanctions. False or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the contracting authority may also lead to exclusion. The bidder must not have breached applicable environmental, social or labour-law obligations. The bidder must also confirm compliance with national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where relevant, the bidder may be asked to describe remedial measures demonstrating its reliability. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions, and that it will not use, for more than 10% of the contract value, subcontractors or suppliers connected to the Russian Federation in the prohibited ways specified in the procurement documents.

The bidder must have completed at least one similar contract during the 36 months preceding the date of publication of the contract notice. A similar contract means the sale and transport of pellets or wood chips. The bidder must provide the contract description, total value, performance period, contracting authority and contact details, together with the other requested evidence. The bidder must submit proof that the offered pellets comply with EVS-EN ISO 17225-2:2021, “Solid biofuels — Fuel specifications and classes — Part 2: Graded wood pellets”, or an equivalent document. The producer of the delivered pellets must hold an FSC or PEFC certificate, or an equivalent certification. If the bidder supplies the pellets as a reseller, the reseller or trader must hold an FSC or PEFC certificate for resellers or traders, or an equivalent certificate. The bidder must submit the required participation statement and confirmations, confirm compliance with the procurement documents and the prescribed pricing structure, and provide evidence of equivalence where an equivalent product, standard or certificate is offered. Joint bidders must appoint an authorised representative and submit a power of attorney; they are jointly and severally liable for contract performance. The bidder must also identify and justify any trade secrets, or confirm that the tender contains none.
