Compliance requirements

The bidder must confirm that neither the bidder nor its representatives have, during the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, child labour or human trafficking offences. The exclusion grounds also cover tax or social security payment arrears, bankruptcy, insolvency or liquidation proceedings, arrangements with creditors, assets under the control of a liquidator or court, suspended business activities and serious professional misconduct. The authority will also assess anti-competitive agreements, conflicts of interest, prior involvement in preparing the procurement, early termination or sanctions resulting from serious breaches of previous contracts, and the submission of false information or failure to provide required information. Under Estonian law, exclusion may also result from enabling an unlawfully residing foreign national to work, contracting with a person subject to international or national sanctions, local tax arrears owed in the contracting authority’s area, a tax offence or a legal restriction on submitting a tender. Where an exclusion ground exists, the bidder may, where permitted by the tender documents, submit evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

Within the 36 months preceding the commencement of the procurement, the bidder must have properly completed at least one contract for the sale and/or rental of lighting decorations including installation, with a value of at least EUR 20,000 excluding VAT. The ESPD must include a list of completed contracts with the contract signature and completion dates, value, and the customer’s name, email address and telephone number. The contracting authority may verify the information with the customer; upon request, additional explanations, data or documents concerning information not readily verifiable in public databases must be provided within 5 working days. The tender must comply with the procurement documents and must be unconditional. Prices must be stated in euros excluding VAT, to two decimal places and using the required pricing-form structure; all lines must be completed and prices must include all costs necessary for proper contract performance. Zero and negative unit prices are not permitted. Where relevant, the bidder must provide an explanation and evidence of equivalence. In a joint tender, a power of attorney for the joint bidders must be submitted. If subcontracting is used, Annex 6 must be completed with information about the subcontractor, the nature of the work or service and the subcontracting share. After contract award, a liability insurance policy for EUR 30,000 must be submitted within the period specified in the contract.
