Compliance requirements
The tenderer must confirm that neither the tenderer nor members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the tenderer may submit evidence of self-cleaning measures where permitted. The tenderer must also confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Estonian Public Procurement Act (RHS).
Qualification criteria and exclusion grounds
The tenderer must have carried out at least one contract for a similar object within the 36 months before the contract notice. The similar object is installation work for traffic counters and the transmission of counting data to the client. The reference contract must have had a value of at least EUR 10,000 excluding VAT. The tenderer must provide the object of the contract, reference number if it was a public procurement, client, client contact details, period of performance and value excluding VAT. If the client requests it, the tenderer must also provide a confirmation letter from the client that the reference contract was performed in accordance with the contract. The tender documents also require confirmation that the offered traffic counters meet all technical requirements in Annex 5 and that the tenderer has any activity licence or registration required by law for performing the work in Estonia.
