Compliance requirements

The tender documents list the standard exclusion grounds, including criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour and other forms of trafficking in human beings. If an exclusion ground applies, the bidder may be allowed to demonstrate self-cleaning measures where the procurement documents so provide or where the law allows it. The bidder must answer the exclusion questions and, where requested, provide dates, reasons, persons concerned, exclusion periods, self-cleaning descriptions and electronic evidence details.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment if required by that country's law. For Estonian bidders, the contracting authority checks the commercial register and may request proof of registration. To provide the service, an Estonian bidder must hold the operating licence referred to in section 15(1) of the Insurance Activities Act, covering the employee health insurance service that is the subject of the framework agreement. A foreign bidder must have an equivalent licence if such a licence is required in its country of establishment. The contracting authority may request proof of the licence if it is not freely available from public data. The bid must comply with the tender documents and conditional bids are not allowed. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bidder must also provide the names and personal identification codes of authorised persons, or confirm that there are no such persons.
