Treatment of Municipal and Industrial Wastewater and Production of Process Water

The bidder must confirm that neither the company nor its management, supervisory body members, representatives or controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must not have outstanding tax or social security payment obligations. The stated threshold for tax and social security debt is EUR 0; according to the notice, tax debt below EUR 100 or debt covered by an agreed payment schedule may be treated in accordance with the applicable tax rules. The bidder must also confirm that it has not enabled an illegally residing foreign national to work and that entering into the contract would not violate international or Estonian sanctions. For first-tier subcontractors, the contracting authority checks the exclusion grounds in the same manner as for bidders; first-tier subcontractors must submit a European Single Procurement Document. The bidder must confirm that it will not use a subcontractor who would have to be replaced under the applicable procurement rules. In addition, no more than 10% of the contract value may be performed by subcontractors or suppliers that are Russian citizens, residents or entities established in Russia, entities more than 50% directly or indirectly owned by them, or persons acting on their behalf or under their instructions. Where an exclusion ground exists, evidence of remedial measures may be submitted if permitted by the procurement rules or tender documents.

The bidder must be registered in the commercial register of its country of establishment and provide the registration details or supporting evidence. The bidder's net turnover must be at least EUR 1,500,000; the requirement applies to all three lots. Within the 60 months preceding the start of the procurement, the bidder must have completed at least two contracts for constructing, reconstructing or installing membrane wastewater treatment plants with a pollution load of at least 150 population equivalents, and at least two contracts for constructing, reconstructing or installing water treatment based on reverse osmosis with a capacity of at least 30 m³ per day. A contract concluded earlier may be counted if the works were completed within the preceding 60 months. The bidder must list the relevant contracts in the European Single Procurement Document and provide evidence of proper performance at the contracting authority's request. The requirements apply to all three lots. The bid must comply with the procurement documents, must not be conditional, and must follow the prescribed price submission structure. Any proposed equivalent solution must be explained and supported by evidence where necessary. For a joint bid, the bidders must appoint an authorised representative and include the required power of attorney. The bidder must identify and justify any business secrets, but may not classify the bid price or other prohibited evaluation-related figures as business secrets. The bidder must also provide the required confirmations concerning sanctioned goods, suppliers and subcontractors.
